How bad is the blue slip? Lots of us have gotten them and been successful. Post the details for everyone to give feedback before going for the attorney.

Marc Ellis is the attorney that many have used. He posts on VJ as well. I'm pretty sure that EllisIsland is his VJ ID.

They are nice guy and knownlge they willing to help you ,may ask them and tell them what is going wrong with your case.and comedown

Thanks all for responding to my post.

Just a quick summary of what being asked to submit:

1. detailed timeline

2. list of her relative with proof of residency in US

3. her ex's name, address and proof of residency

Knowing her since 03/2006, visited her 3 times, engaged last year in September.

Proofs include chat log, phone record for 3 yrs, pictures of 1st , 2nd , and 3rd trips.

This case is one of complicated ones due to her previous mariages. She was previous K1, came to US in 2004, got married then divorced in 3 months before changing status. She re-married with another guy then come back to VN. Thing also did not go well, so they divorced in 2007. All divorces were handled by US courts.

We have all proofs for the ongoing relationship, but we are afraid that HCMC still puts our case under AR after we submitted all requested docs, and finally return our case back to US.

At this point, we are working to have all docs done and cross our fingers :(

Several questions I have in mind:

1. does it help to hire a lawyer for this case?

2. what will happen after docs are submitted? I have heard that HCMC even does ground work, phone calls, etc... for the investigation.

3. Do they have any ground to deny visa even we can prove that our relationship are bona fide?

Your helps/suggestions are appreciated.

Wow, I would definitely get a lawyer for your case.. That is super complicated... She married 2 times before meeting you during the 1st immigration process and she's been to America too, doing the same process now. That just looks fraudulent in a lot of ways. They probably have access to her files from back when she had her 1st k1 visa and I think it would be tough to get another k1 within 5 years of the last one. If this K1 fails and you really love her I would go the CR1 route. It's a different visa and seems to be a lot easier than K1 in my opinion. Lots of people who fail the k1 route go CR-1 Route. I wish you good luck in this case and I hope you can find a really good lawyer to help you out with this.

Yes. A good attorney will be able to tell you how to adequately address those red flags. The timeline is pretty much SOP at the HCM consulate. The other things they're asking for indicate they are suspicious that she's using you to get back to the US and re-unite with a previous spouse.

Marc Ellis has been suggested. I doubt you could do better. He spends about 2/3 of his time living in HCM.

Yes, but they don't do those things in every case. However, they DO access public records on the petitioner as part of their standard background checks. They have access to any records about you in the Nexis database. Marc can tell you how to get a copy of these records so that you'll know what they know.

3. Do they have any ground to deny visa even we can prove that our relationship are bona fide?

"Prove" is a relative term. You might think you can prove it to your satisfaction, but they can find the most unbelievable grounds to deny a visa. Did you ever wear the same shirt in more than one picture? If so, they can claim the pictures were taken on the same day, even if you KNOW they were taken on different visits to Vietnam.

What makes it even more complicated is that your fiancee can bring in a truckload of "proof", and they aren't obligated to look at any of it. In fact, if they suspect the relationship is a sham, then they probably won't ask to look at anything. The only things they are certain to look at are the things they specifically asked for on the blue slip.

The list of relatives and the proofs of residence are pretty straightforward. Your REAL opportunity here is the timeline. That's where you'll have a chance to present your evidence and make your case that the relationship is real. Again, Marc and his staff can help you with this.

I would submit what they ask for, and has a lawyer behind your back. If thing go SOUTH.

Your case is kind of close to ours and we really had trouble. Xuan did not come to America on her first petition and still had a TON of trouble with HCMC consulate. I will try to paste a link here so you can see what we went through AFTER we got the pink sheet due to her previous K-1 petition.

1 TIMELINE - Asked for all the time now. Not a big deal, just produce a detailed timeline and submit

2 RELATIVES IN THE US - Typically requested. Given your fiancee's circumstances very understandable. Take the time to do it right to avoid any additional RFE

3 EX INFO - We had to provide info about my ex (she was not a US citizen) including proof of her current US address. My ex was not cooperative but they accepted my letter. That request is not so unusual. PM me if you need help with this part.

Your fiancee's history threw up a red flag. So you have to give them the info and explain the story. Life isn't always neat and simple. Give them the truth, don't assume anything.

Remember the CO can only evaluate the info submitted. If you leave it out and the CO can't read your mind- blame yourself.

It sounds like you can produce what is requested. Get it all together and have an attorney review your info if that will give you peace of mind.
