can we apply for AOS while overseas?

my fiance is in the US army, and is stationed in Okinawa Japan, at the moment we are waiting for our K-1 visa. But we have also already discussed about applying for the AOS. After we get married in US, we will file asap for command sponsorship and it can be done(accdng to his admin) within 2 weeks max. When we get the orders cut, i can fly back with him to Okinawa after his leave. 

 Our immigration specialist has already told us that i am able to leave US without it being considered abandoning since it's on orders and that I won't need travel parole to do that.

Is there a time limit as to how long since my entry in US & the wedding to file for the AOS

And i've read that in the application of the AOS, there will be an interview conducted so i don't know how that will work out for us just yet. Idon't know either how i can do the interview having both of us overseas.

If you have any knowledge about this or have experienced the same situation please do enlighten me. Thanks!  :star:

02/25/10-GC approved

08/26/10-319B n400 starts

11-09-10 Interview 10 AM >Approved

Timeline

You will have to apply for AOS before you can leave the US.. You need the Advanced Parole(AP) to leave the US after marrying on a K-1. and Usually the AP is filed along with the AOS. The AP takes about 60-90 days to be approved. but I believe it can be expedited.

May 2nd, 2008 -- Visa Interview = Approved. (91days)

May 27th, 2008 -- Damian moves to America!

July 23rd - 30th, 2008 -- Damian's Mum Comes to the US for our wedding.

July 25th, 2008 -- Wedding Day!

March 16th, 2009 -- AOS Sent

May 8th, 2009 -- EAD & AP Approved (51days)

July 14th, 2009 -- AOS Approved!! (118days)

July 21st, 2009 -- Green Card Received (125days)

No RFEs the whole process :) All done myself.

December 4th - 30th, 2009 -- Visited England

April 8th - 30th, 2010 -- Damian's Brother visits us here in PA.

January 19th, 2010 -- Damian got his PA license.

December 10th - 19th, 2010 -- Visited England

September 16th - 30th, 2011 -- Damian's Parents came to visit us here in PA.

June 1st, 2011 -- Mailed ROC to Vermont.

February 21st, 2012 -- 10 Year Green Card Received

April 14th, 2012 -- N-400 Sent to Dallas Lockbox

November 26th, 2012 – Damian Became a US Citizen!!!

You can file the AOS immediately after marriage...or I should say, immediately after you get your marriage certificate. If you tell the officiant before hand you should be able to arrange to get it the same day or next day. Thats what we did and got the certificate the next day by bringing the signed off marriage lisence to the town clerk ourselves and waiting a few minutes while they made the certificate.

Not sure about needing the AP or not. I am not suprised they have special rules for military personnel, I just am not familiar with them. Just make sure about that before you leave.

Normally there IS an interview (sometimes not) and they will send an interview letter to the mailing address you provide BUT it must be a US mailing address, maybe a relative can accept that for you. If there is an interview, you will have to come back for that.

well our immigration specialist said i would not need the AP anymore since it may be considered as US territory since it's thru orders and all; but im just conderned about the AOS and the interview;

we are just going to be staying in the states for however long his leave days will be, most probably about 3 wks; but yes we have yet to discuss about filing the AOS Asap

will the applicant for the AOS always need to undergo an interview?
