Petitioning my mother in law

Timeline

Does it has to be my wife petition her mom? or I could petition her as a family member. My wife is not working this time and we are hoping that we could bring her mom here in the US since she is the only immidiate family that my wife has. My wife has been here in the US for over 2 years as a green card.

is the visiting could be a good possibilities?

Since your wife is not an USC, she cannot petition at this time. (LPR petitions)

You cannot - as she is not your parent. USC petitions

Perhaps she can get a visitors visa - only way to know is for her to try.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

US Citizens cannot file an I-130 for IN-Laws.

Who May Not File This Form I-130?

8. A grandparent, grandchild, nephew, niece, uncle, aunt, cousin, or in-law.

Your spouse first must naturalize and become a US citizen, and at that time your spouse can file the I-130s for parents.

You don't do a visitors visa, your in-laws apply for it them selves by filing a DS-156 at the Embassy. You can help by providing a letter of invite, and perhaps an I-134 to show how they will be supported while visiting.
