AOS Application pending for almost 2 years now

I hope somebody could bring some light on my depressing AOS application journey. As you can see on my timeline record, they received my I-485 application July 23, 2007. Had my biometrics taken Sep. 2007 and transferred my case to California SC same month. On Oct. 2007, I submitted my vaccination record after receiving notice requesting for it, and as stated in the online case status, they received the said document Nov. 2007. And darn, my case status was never been updated on their website since then!

After tons of phone calls and inquiries to their Customer Service, on May 2008 we received another notice which was adressed to my husband for biometrics appointment. Since, I already had my finger prints taken and my husband as a natural born US citizen, we got confused and verified this to Customer service, which they claimed an error and advised as to disregard the appointment. And so we did!

Again, after numerous calls to their 1-800freakin' number (sorry really got carried away!) and couple of visits to nearest USCIS office, we received no answer of the delay but the surge of the USCIS application because of their fee increase last July 2007.

On December 2008, we wrote a letter to the USCIS Ombudsman and we were contacted by them. Unfortunately, they informed us that the reason for the delay was the 'NO SHOW' on my husband's biometrics appointment. They said, it was NOT an error and it is a 'NEW' procedure (which im not sure, how true it is). Lesson learned: their CS dont know a damn! so if you have an important question, get an infopass and talk to the USCIS officer. Anyway, we recieved biometrics appointment again for March 2009, this time it was two separate notices named to each one of us. Sadly, we needed to reschedule because of my hubby's unavailability. Adding more to our confusion, I got reschedule last May for my second biometrics but received no appointment for my hubby. So, do they changed the 'NEW' procedure??? As of now, it's almost two months since my 10-finger prints re-taken...

Please, anybody here could say something, at least just to calm me down (just kiddin'). All I need is my two-year green card so I could start working. My bad, I did not applied for EAD, and no plans of applying neither, dont want to get more screwed and pay 340 bucks!

Please if you have any idea, let me know what I can do next, aside from waiting....

May- Dec '08- Several INFOPASS appointment

Nov 2008 - Hubby took me to DMV for Driving test! Got my DL!!!

Dec 2008 - Reply from CIS Ombudsman

Jan 2009 - Still NO updates

May 2009 - Second Biometrics

July 2009 - Sent letter to CIS Ombudsman

Oct 2009 - Sent letter to USCIS

Dec 2009 - Transferred from CSC to NBC Lee's Summit, MO

Jan 2009 - Interview Notice

Feb 1 2009 - Long awaited INTERVIEW DATE

Feb 19 2009 - CARD PRODUCTION ORDERED

Feb 22 2009 to present - Please Mr. Postman look and see......c'mon deliver the letter, the sooner the better... (singing...hahaha)

Feb 23 2009 - CARD PRODUCTION ORDERED email (again!!!)... such an agonizing moment! can't wait no more

You are definately in (at a minimum) InforPass appointment territory if not at a stage where an elected official's help may be in order (Senator/Congressman).

I have no clue why a USC would need to do biometrics nor what they would do with it afterward. :unsure:

My bad, I did not applied for EAD, and no plans of applying neither, dont want to get more screwed and pay 340 bucks!

You do not have to pay for an EAD if you apply for it after you applied for AOS. You will have to include a copy of the NOA (receipt) that you received when you filed your AOS with the EAD application.

Maybe doing this would "jump start" your AOS process.

I never heard of biometrics for USC. Does your husband has a criminal record?

I have seen this "new" procedure - part of the background check of the USC - if there is something "fishy", they ask for more info (IE bio)

Something "fishy" could be a common name (with illegal dealings)

There are a few posts here about this. Best thing to do is to show up and submit for processing.

Here is the statement I found on DHS:

Biometric and Other information Collected to Conduct Background Checks: Title 8 U.S.C. Section 1324a requires criminal history background checks for USCIS applicants. In order to meet the requirements of 8 U.S.C. Section 1324a, USCIS conducts four different background checks on applicants/petitioners applying for certain USCIS benefits (e.g., applications for Permanent Resident status) (1) A Federal Bureau of Investigation (FBI) fingerprint check, (2) a FBI name check, (3) a DHS Customs and Border Protection (CBP) Treasury Enforcement Communication System/Interagency Border Inspection System (TECS/IBIS) name check, and (4) an IDENT fingerprint check.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You do not have to pay for an EAD if you apply for it after you applied for AOS. You will have to include a copy of the NOA (receipt) that you received when you filed your AOS with the EAD application.

Not sure on this one ( EAD no fee ) as they applied before the fee increase so I think they need to pay for the EAD, However OP there is a filer in the MENA section thatjust received their interview and have been waiting since 2005 From MENA Forum. I hope with the request for the fingerprints it will move your case along . Also guess maybe the USC had some dealings? Not sure there cause my closest was not the best when I applied for my husband and it was never brought up.

No fee if your in the AOS process - NOA is all you need (says so in the EAD instructions on the form) - as long as the NOA receipt date was after July 30th, 2007.

You can file with the initial submission or after.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I am positive that my husband has no criminal record. But if in case he has, am I to suffer for the consequences of this? We are too willing to submit for fingerprinting, but as of today, we haven't receive any biometrics appointment for him. Also, he was in the navy before, couldn't they check his file on his military record or some sort? It is really strange, but we'll probably get an infopass next week, I will let y'all know what they'll say. So others who might encounter such similar dilemma will have an idea what to do.

With regards to the EAD, I am not qualified for the 'no fee' since I applied before the fee increase and my application receipt date was July 23, 2007.
