Hi everyone, i previously stated that my husbands interview was today, he passed but needs me to submit a no tax letter from me the petitioner. Ive already sent the letter. The co told my husband that when thay receive the letter, they will call him to bring in his passport so they can give him the visa. All the paper said was "cannot issue visa at this time, and in order to complete the case, send in ........

my question is: is it bad that they didnt just take the passport right there and then?, instaed of calling him back to send it.

I have been soo emotional today, i think my eyes are even puffy from crying and feeling soo down. I thought hed be here by our first anniversary which is about in 3 weeks., its also his bday.

the embassy will have my letter next week, is it possible for my husband to be here maybe by the end of july, i mean they told him as soon as we receive letter well call you to send in passport, so do i have hope for him to be here in july???? i really hope so, i cant cope with this, its too painful to be away from him.

It varies from one consulate to another, but most won't ask for the passport unless they have all of the documents they need. They may ask for the passport if they have everything, and only final checks are still pending. I wouldn't worry about them not asking for his passport yet.

I can't even begin to guess if he'll be here by any specific date. You could be be approved, he could submit his passport, and it could still be hung up for weeks or even months in checks. It's just impossible to guess. Check the regional forum and reviews for your embassy to get a better idea what to expect.

You must stay calm. It is possible he will be able to come in July, but immigration does not go by strict time-tables. It could take longer, and if you prepare yourself for that, it will be much sweeter if he comes on time.

the paper never stated that he was in review or he was denied or anything like that.

Does this mean that hes pending checks or something, i thought they just label it as 21g until they receive what they are asking for, am i right?

i hope everything goes quickly.

yes but that doesnt mean that after they get what they need from you they won't put him into AP or anything. No one can tell you for sure, but if they call him in and ask for his passport everything should be ok.

you are fine. when they get the paper, start emailing the consulate to find out when its approved. every place is different. ours took about 2 weeks after submitting the extra things they wanted, but that was in montreal.

I do not want to alarm, but prepare you. Your country is common for Admin processing. Even though you still had required documentation due, you still might be put in AP. AP averages around 4-8 months sometimes more and sometimes less.

I think you mean 221(g). This is a section of the Immigration and Naturalization Act - the primary US law that covers visas and immigration. Section 221(g) is a "catch all" for the consulate because it's one of the only sections in the law that gives a consular officer the authority to make a judgment call on a visa application. If the consular officer decides to hold up the visa because the applicant forgot to sign a paper, they'll cite section 221(g) in the letter. By the same token, if the consular officer decides to send the entire package back to USCIS with a recommendation that the original petition be revoked, they'll cite 221(g). All they're really saying is "This is the section of the US immigration law that gives me the authority to take this action". In your case, the action they're taking is simply asking for more documentation.

Whether they issue the visa after receiving the requested documentation depends on why they were asking for the documentation, and whether the submitted documentation confirms or refutes their reason. For instance, if they are inclined to deny the application, and the documentation reinforces their suspicions, then they'll deny the application. In your case, it sounds like they're inclined to approve the application, but have questions about whether the public charge guarantee is being adequately met, so they're asking for more tax documentation. If the documents you provide satisfy them, then they'll approve the application.

As others have said, AP is common at your consulate. It's possible it could be only a few weeks, but being stuck in AP for several months is not at all uncommon. Don't make any concrete plans until your husband has the visa in hand.

you are fine. when they get the paper, start emailing the consulate to find out when its approved. every place is different. ours took about 2 weeks after submitting the extra things they wanted, but that was in montreal.

You are from a very different consulate. They could be looking at an average of 4-8 months.

Sounds like the interview went well, which is common. AP really is just another part of the process for the OP area. The confusing part becomes when they need to submit additional documentation, but remain in AP. Plan for the worst get surprized by the best.

Hi everyone thanks for the advice. I hope once the embassy receives my letter, they will approve it quickly and hopefully call my husband to bring in his passport. The co told him its not a big deal and everythign is perfect in your file, we just need a wriiten statement from your wife saying she doesnt pay taxes because she doesnt work, signed and dated. I mailed the letter a few hours after my husbands interview.

Now i will just pray that they approve it quickly with no problems or delays. I will email the embassy a few days after my husband sends it to make sure they got it and nothing else is needed to complete his case. I hope to soon get good news.
