Very Frustrated and annoyed at my friend who cheated

hi folks..just found out that my friend cheated by not doing K-1, and instead married his fiancee/gf of 2 YEARS while she was here on a Tourist Visa, and now they are happily living together without ever having been caught!!!

He should have gone through K-1 and waited like the REST OF US......

My question is can I do anything to rat him out (I dont care about friendship anymore--we were never really that close anyway)....

It just boils my blood knowing his story and how he got away with it!!!

Why do you have to be bitter about it?? I would suggest to let them live.. and we move on.. :thumbs::thumbs:

With friends like you(OP), one wouldn't need an enemy! If this friend was your family member, would you rat them out as well? I am so sure you don't even have enough information about their case for you to make such a decision but sheer jealousy has beclouded your sense of reasoning! Give them a break and be happy that at least they are not going through this hell which a lot of us have gone through just to be with our loved ones, that's what true friends are there for. If you knew about their intentions initially and didn't advice them, then you are at fault but if you see it's worked out for them and just want to be a hater then SHAME on you. :angry:

Nick, the 90 days is to get married. The "decision" was made at the time of proposal and acceptance.

Tell that to my wife's friend that came over on a K1 marrying a motel owner and already decided to get married. Day after their wedding, he told her to start cleaning rooms. Still say, it takes time to know what you are getting into and the K1 doesn't allow that time.

Nick, the K-1 is there for those who have already made up their minds and know what they're getting into. A large number of people didn't have an online relationship with travel restrictions before making a decision to marry. Just because people are using it for other purposes doesn't mean that that's what it's for.

I sure did. And the first two cases that I stated that I knew personally both misrepresented at the POE. Obviously what "can" happen did not. They are both here with residency status without a question even asked by the CO. To me this shows that what happens in immigration-land isn't as it should be.

Is that what you were getting at with referency John and Marlene's post? Did I miss something?

I should say that I am not suggesting that people should go this route. Obviously, me and my husband adjusted from K-1 and are happy we did so.

What I am saying is that I am questioning the assumptions that many people seem to work off. The assumption that 1) people who enter with intent at POE will be found out and the majority will not be able to adjust status 2) If they did adjust status it is probably because they did not have intent upon entry and therefore the system worked as it should 3) It doesn't matter if people do make it through illegally. You should just worry about your own visa journey and be happy that you are doing it right.

And in terms of the stats that I was refering to...I am more interested in status that deal specifically with intent upon entry. I recognize that people who enter without intent and get married have every rgith to. What I am more curious about is if anyone in the gov. (or anyone else) has reported on how many people they believe enter the us with intent and get married, and how many are denied adjustment through the process.

Be careful there.

John is right in what he wrote, but you have to remember, each reason for the "cannot" were based on a court cases, as in, the immigrant had to hire lawyers, go to court, fees, etc... to fight the Law.

If the IJ/USCIS/ICE gets their dander up over you case, even though you have these court decisions, if they take you to court over something in your AOS, you would be responsible to fight it if it got that far.

Remember, burden of proof is on you, not USCIS, et cetera! If you have a crackerjack lawyer, they should be able to sort it out, if you don't...

If push came to shove, they can pour over your entire case, and if they find one single thing you misrepresented, or if all the negatives make your immigration not in the best interests of the US, game over.

I know of one case personally where it resulted in a ban (vwp) because of misrepresenting. The couple are still paying for that little "white lie" ...

To the OP -

Get over your sour grapes :crying: , your "friend" didn't do anything wrong :innocent: . You did! :devil:

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

TBC....

You don't need to be - people planning on "gaming" the system will need to be :)

I should of made that more clear :whistle:

You know, the people that go "Is it possible to come to the US, get married and AOS, on the VWP/B2/ETC?????"

(Yes it is possible, but then they would be responsible after that point for any PAIN coming down, if applicable)
