During that 2 year period, did you two meet together at all?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

no, in that period we did not met in person, but we talk online or on the phone almost every day

I am unsure of the correct answer for your situation. Perhaps others with more insight will be along to answer. All I can offer is a suggestion. If there is anyway at all that one of you can fly to meet the other, do it at the earliest possible time. It could only help your case.

Does it matter, since they're filing for a marriage visa, not a K-1?

LOL - I wasn't going for that angle - I was just confirming what the OP wrote.

I was just curious if they met (as married people tend to want to do) during that period of waiting. (or if the OP made a mistake in the timing)

As a consulate officer, I may question that (length of delay), but I doubt it would have major impact, as long as they are not from a high fraud country.

then it might get a bit hairy.

thank u guys a lot...of course we wish we met in these 2 years, just life is so unfair sometimes... so u think that should not be big problem in ambasy, but sugest to find way to meet before interview, right?

It *shouldn't* be a problem - perhaps someone from your part of the world (embassy specific) could give you a better answer.

I know I couldn't stay away from Umit for 2 years without going crazy, 5 months is pushing it

You're right...it would be a question that would come up and need to be addressed at the interview.

If at all possible you should try and see each other once before you're called for the visa interview at the consulate. As Bobby points out, it is a valid question...why, when you've been married for 3 years have you not seen your husband in more than two years? And "I have no money" is not an excuse because you have to have enough money to sponsor an immigrant....so the no $$ excuse does not hold much water.

Sister Len asked the big question: how will you prove a marital relationship? A letter from a family member isn't the strongest evidence. Look at your situation through a CO's eyes and address the weak points.

Are there any joint bank accounts? Jointly help property? Has the USC spouse filed taxes as married?

You haven't seen each other in a couple of years. Why? As stated before, citing financial difficulty isn't too viable as now the USC will be sponsoring the spouse.

There are lots of couples who dont get to see eachother through this process. My husband and I hadnt physically seen eachother for over a year by the time he interviewed and it didnt create ANY problems at the consulate

As long as you can address the question at the interview, I dont think it is a problem in proving the bonofides of the marriage. Just prove that you guys have ongoing communication, like everyone else does when they cant just fly off across the world while waiting. :)

The fact that you guys didnt file right away does put you in a slightly different category.

Anh Map brought up some good points though, so you guys have any joint accounts?

If there is anyway that he can come visit you, that would be great of course.

"you fondle my trigger then you blame my gun"

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!
