I submitted my AOS back in march of 2008 and my case has been pending since then!. I seriously don't know what to do anymore.

I contacted the ombudsman, the senator, and governor of my state and all i have gotten was a we're looking into it letter from all three.

I also set up a "Over the normal processing times inquiry" with USCIS back in April, and the only thing I have recieved at the beginning of JUNE was a notice to retake my 10 fingerprints, because they were expired! I contacted customer service and they told me they can not set-up another inquiry because I have receievd an update on my case, which was to retake my fingerprints.

Now i really don't call this an update.... b/c dang it! I just want my 10 yr GC!. Now i know i can apply for Naturalization at this point, but unfortunately i lost my job in May. My husband is now the only one working and we just can't cough up that amount of money at this time... not until i get another job in this horrible job market!. :angry: I dont know what their waiting for... I haven't receieved no RFE, no interview... just retake ur fingerprints an wait!.... anybody else out there in this same situation.

Wait, if your AOS is still pending (and not the RoC) you actually are not eligible for naturalization either, since the 3 years count from the day you became a permanent resident, and if you haven't yet received your conditional GC you're not yet there.

Unless you meant the RoC is still pending and you do have the conditonal card, in which case applying for naturalization could actually be the push needed to get your petition approved.

your time line says removal of conditions and you talk about the AOS here. What exactly your waiting for? If its the removal of conditions then case can take upto 2 years sometimes. BTW this is the removal of conditions forum.

2. when did it expire?

Yes i'm sorry that's what i meant the ROC... which yes does make me eligiable to apply for the N-400... but unfortunately like i mentioned before i lost my job last month. We really can't afford to file the N-400 until i get another job. :( soo.. i'm at USCIS's mercy.

Yes i meant the ROC.. sorry i got the terms mixed up. But yes i recieved my conditional green card in June of 2006, filed the AOS in April of 2008 and my 1 year extenstion expired in March of 2009. I got my i-551 stamp in april of 2009 and now i have just been waiting and waiting!!!!

They way I understand it, and by all means please correct me if I'm wrong, if a "permanent" resident with a 2 yr. GC has filed his or her I-751, received a NOA and a 1 year extension, and it happens that the process takes long enough (90 days before 3rd. anniversary of 2 yr. GC) for the N-400 to be filed . . . this person is still not eligible for naturalization as long as the I-751 application is APPROVED.

So in this case, everything is still on track, albeit with a very unfortunate delay, but as long as she doesn't get her approval letter, there's no point in filing the N-400, is there?
