I submitted my AOS back in march of 2008 and my case has been pending since then!. I seriously don't know what to do anymore.

I contacted the ombudsman, the senator, and governor of my state and all i have gotten was a we're looking into it letter from all three.

I also set up a "Over the normal processing times inquiry" with USCIS back in April, and the only thing I have recieved at the beginning of JUNE was a notice to retake my 10 fingerprints, because they were expired! I contacted customer service and they told me they can not set-up another inquiry because I have receievd an update on my case, which was to retake my fingerprints.

Now i really don't call this an update.... b/c dang it! I just want my 10 yr GC!. I dont know what their waiting for... I haven't receieved no RFE, no interview... just retake ur fingerprints an wait!.... anybody else out there in this same situation.

Hi Sunshine14,

I know that you are frustrated. First of all please don't use huge font size, it comes across as being very angry, rude and rash. You could have typed this in the regular font size.

Now to your question. You mentioned you file for AOS in march 2008 while your time line says you file for removal of condition (ROC). AOS and ROC are two different things. If your question is regarding AOS then this is not the correct forum to ask.

Ask them in this one:

If you did in fact applied for ROC for your 2 year conditional card, something doesn't seem right as most of the folks who applied in 2008 close or same as your time line got approved.

As I have seen on VJ and other forums contacting ombudsman has helped very few. I think contacting Governor is just wait of time as they wont help and I think they don't have jurisdiction on USCIS case processing.

The best solution is contacting your senator/congressperson. You did mention that you did contact your senator. I think may be you didn't follow up with until they solved your case.

Like you should have asked for their immigration liaison and should have talked to him/her and should have told about your case. He/she would then have asked for authorization by sending via email or fax inquiry forms etc.

If you even did that, then you should have definitley got some response. But an inquriry done by either a senator or congressperson either results in a RFE or an approval as I have seen on VJ.

I would advice you to go meet your senator by making an appointment and his/her immigration expert. If the senator doesn't help then try meeting your congressperson in person by setting an appointment and then their immigration expert.

Those two are only best options while dealing with USCIS as they have authority to do an inquiry and investigation regarding your case and get it expedited.

Hope it helps.

Wish you good luck.
