Am I reading this wrong or what...

Is this stating that K-1 do not need work authorization to work and K-2 K-3 K-4 do?

This info is from

Could this be why they give no temp work authorizations at POE nowadays...

1. Aliens Work Authorized Without Specific DHS Authorization

The following sections list nonimmigrants, by alien class of admission codes, who are authorized to work in the U.S. without specific authorization from DHS. The person’s I-94 will not have the DHS employment authorization stamp and the alien will generally not have an EAD.

Required evidence for employment authorization is either a Form I-94, Arrival/Departure Record, showing a class of admission that indicates the person can work without specific DHS authorization (RM 00203.500C.1.)

The I-766 shows “A-6” under Category; the I-688B shows “(A)(6)” under Provision of Law.

K-3

Spouse of U.S. Citizen

The I-766 shows “A-9” under Category; the I-688B shows “274a.12 (A)(9)” under Provision of Law.

K-4

Child of K-3

The I-766 shows “A-9” under Category; the I-688B shows “274a.12 (A)(9)” under Provision of Law.

So, any opinions or knowledgeable individuals tell my error in understanding this?

Please do a search on VJ for K1 and work. The SSA do not decide who can and can not work the is done DHS. A K1 can not provide the correct documents that are required for the I-9 form when starting employment and are no longer Empolyment Authorized.

This question is asked every week and the answer is still the same as it has been since the begining of April 2009. K1 can not work until they have a EAD, so that they can comply with the list of acceptable documents for the I-9.

So, you are saying that even though the I9 which you quote as gospel cannot be filled out.

Well then explain how according to it we have the required documents to fill it out and thus could qualify.

Section B says : Valid State ID

Section C says: SS Card

I9 says you need One ID from Section A OR One ID from Section B AND One ID from Section C

Getting SS Card it states in their rules you can get if "K1" requiring NO authorization to work, and when we went and got our SS card receipt and paperwork it stated LEGAL ALIEN AUTHORIZED TO WORK.

Maybe i'm confused about the I9 requirements, could you point out what I may be missing in my interpretation of the requirements.

Her SS card will say on it "valid for work only with DHS authorization." To satisfy the I-9 she will have to show the authorization (EAD).

Also, more employers are using the E-verify system. IF she's not showing as eligible in that system, no one will hire her.

And if she's actually eligible to work but E-Verify is just wrong (this scenario is quite common), then just say thanks to your retarded older brother, Uncle Sam, for yet another job well done.
