for those of you that are living happily ever after, Good for you! but sometimes you have to think both ways. of course those are happy now will disagree about my 90 day comment, but those that got burned will probably think differently.

K-1 is for marriage to the person who filed the I-129F, no other options here.

The only option for the K-1 is to return to home country when the I-94 expires.

It's either get married, stay or no marriage, leave.
Correction, GET MARRIED to the person who filed the I-129F. Cannot marry someone else and adjust, that is NOT an option. The can marry someone else, but will need to do a SPOUSAL visa petition (I-130) and return home to interview for the spousal visa.

well, because this is a long distance relationship meaning we are not in the same country together everyday or every week, we are talking months and months apart, people should use the 90 days to see how they actually like each other living together 24/7, this way there wouldn't be so many people posting here.

I guess your probably going to fuss at me for making this a debate, but oh well.

I don't think it matters if you got burned or not within the 90 day period. The fact remains that the visa is NOT a trial run visa. Do some people realize during that 90 days that they do not want to be together after all? Yes, of course. But those people are the ones that clearly did not spend enough time getting to know each other BEFORE they decided to take the plunge into married. You are supposed to know your FIANCEE enough before marriage and BEFORE you come over on the K-1, that that 90 days living together wont be such a surprise. That's the point. But there will always be the people that meet their fiance and decide to get married the next day. I bet there are very very very few cases (I wont say none, but very few) where the two people have spent significant time together and then decided to cancel the wedding within the 90 day period.

That maybe the case, but I think that there are details of this that we cannot see. If the beneficiary does not marry the petitioner that the beneficiary must go to his homeland, end of story. My other concern would be that this person cannot reapply again for a k-1 in two years at least.

I agree though, the 90 days you are granted when entering on the K-1 is sort of too late to use as a decider for whether you want to marry your fiancé or not. I understand long vacations are hard for probably most people but in that case, perhaps they should be waiting a bit longer before getting engaged. My fiancé and I were lucky enough to date for 8 months while I was in the US, then I lived with him for 4 months total (30 days at the end of my J-1 visa, then 80-something days on the VWP) and we’re coming up on our two year anniversary in August, so we’re very solid on the idea of being together for the rest of our lives. I sure wouldn’t give up my country, family and culture for just anyone! (Australia is, hands down, an AWESOME place to live… it’s a special man indeed that convinces me to go back to the States)

OP, sorry if some of the replies were a bit suspicious... There are a few threads floating around on this and I suspect not all of them are genuinely "I'm asking for a friend"... ;)

July 2007 - met Jesse at a beach party held by mutual friends in Long Island, NY

May 2008 - J-1 visa expired, had to move back to Australia

July 2008-September 2008 - lived with Jesse for three months in Staten Island, NY

March 2009 - Jesse comes to Australia for 3 weeks

April 2009 - Engaged!

05/20/09 - I-129F petition mailed in

05/22/09 - NOA1!

05/25/09 - touch

09/09/09 - NOA2!

10/01/09 - due to fiance's illness, we are abandoning pursuit of K-1 at this point. Packet 3 received from consulate but won't be returned.

Not true, this restriction is only on the US Citizen petitioner, NOT the foreign citizen beneficiary. Another US Citizen CAN file a petition for the beneficiary at any time.

BS! "People should use the 90 days to see if they really like eachother...."? Do you REALLY think that? If so....where does that leave the "letter of intent" that was signed by both petitioner and beneficiary? Makes that meaningless, huh?

It's a fair bet that anyone going to their Embassy K-1 interview saying what you just said here " We are going to use the 90 days to get to see if we like eachother" would be DENIED! Rightly so...The 90 days IS NOT for the couple to see if they can tolerate eachother! #######?

YOUR SUPPOSE to be all ready in "love' and ready to marry.

You frigging signed a "Letter of intent" to marry when you get here.....
