you really need a lawyer as this maybe seen as an act of misrepresentation... and may get you booted out of US.

be careful when you seek online advices, i'm not saying all advices here are wrong. you are in a delicate situation

with legalities here, and i hope you won't file anything until you are sure of your rights and the corrective actions you

may need to take.

They would probably want all kinds of evidence to prove she is really your child.

(from my reading, they don't like "tack ons" to approved petitions.)

Lawyer - in this case, may be prudent.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

i can bet u one thing for sure that CO will have ask u what kind of parents r u who forgot to list the daughter?

the question on I-129 does not indicate that u r getting her in usa or not, it only indicate that u list ur kids.

what will be your answer?

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

Your main problem is that you misrepresented yourself on your application. The forms specifically asked for any dependents or children.

Not including your kid on the form because of ignorance or you would petition her later is not an excuse. You have to get a lawyer.

You are in a very delicate situation here. Get a good immigration lawyer, not just any lawyer.. but the one with good reputation and experience.

Now is not the time to worry about money. This could blow up in your face if things are not handled correctly.

Timeline

Shakespeare summed it up well " Something is rotten in the State of Denmark" However, what is really important now is that this lady gets her daughter over to the US with her ASAP. My fiancee and myself just sent our K-1 in and her 10 year son is on the 129-F. I would not dream of her coming without him. Ma'am you do whatever it takes to bring your daughter over to the US with you. I can only imagine how much you must miss each other.
