Anyone have trouble getting a state ID card from a K1 visa?

They tell me they cannot issue one because of the expiration date on the I-94. I have SS number, payroll stubs, marriage certificate, passport, and birth certificate. They claim by the time we recieved the card the I-94 would be expired.

Have applied for AOS

I guess wait for the green card?

Depends which State you're in. Florida wouldn't issue me a driver's license until I had my AOS NOA. Instead they issued me the State ID (long after my I-94 expiry date) then took it away once I got my DL.

How interesting, in florida they didn't let me get my DL with my AOS NOA, I had to wait for my EAD!!! i guess it deppends who you talk to in the DMV and what mood they're in at the moment lol :)

Well, did you click your heels three times and dance in a circle? I think that's what did it for me.

it depends on the State you are in. in TX, they just changed the regulation, October last year. you can't get State ID or DL until you have have at least the EAD. then present EAD and SSN together with your application.

We were told that my husband can't get a state issued ID until receiving the NOA for AOS.

Of course, each state's laws differ. I would call up the DMV/MVA (or go to their website) and ask them what they require.

This depends on the state. Vermont requires you show you can legally remain for at least 180 days. The I-94 itself won't do it, but they will accept the I-797C (NOA1) for filing adjustment of status for an ID and/or drivers license.

How do you have payroll stubs without an EAD? K-1s cannot legally work until they have EAD or Green card, despite what you may have heard elsewhere. The rules regarding the "temporary employment stamp" given at JFK have changed and that stamp was never valid past the date of the I-94 in any case. Better be careful about that. In the past, they overlooked such things as the rules were vague, but as of 4-15-09 the new wording of the I-9 form has been enforced and K-1s do not have the necessary documents to work. I do not know if they will continue to overlook this infraction.

In the state of South Carolina we were told she has to have the EAD and proof of residence as in a recent utility bill mailed in her name to our address. For her to get a bank account she needs the state ID as one hard requirement.
