Hi all,

my fiancee got her k-1 received and approved in December of 2005. She is ready to fly over here this weekend (Feb 17th), but she realized her passport expires in June 2006. She said her father read (somewhere) that her visa must have at least 6 months remaining before it expires for her to be able to come over. In other words, if she gets here on Feb 17th, her visa cant expire prior to Aug 17th, if it does she may be turned away.

Is there any truth to this at all???

If so, will she actually be turned away at the gate? Or will she be allowed to enter and then renew it through the mail from the states. She is from London, England...

If anyone has any knowledge at all regarding this, your response asap will be greatly appreciated! This is something that is last minute and just came up and has us very worried. Thanks in advance! :)

I would imagine that the visa would not of been issued if her passport wasn't in order. Her passport obviously had the required 6 months on the visa being issued.

It could have been an oversight by the embassy when they approved her (doubtful). If it was me, I would just get a renewed passport to be safe, then no need to worry the whole way on the flight wether they would deny you entry or not. You could get it in 2 weeks for around £50 or go down to your nearest passport office and get it in 4 hours for £96, which is what I did.

She will not have any problems with the fact her passport has under 6 months left as long as it is valid when she enters the states she is ok... once you are married she can renew her passport in her married name at the Brittish Embassy in Washington... that is what I did and I have had no problems...

If she enters before the expiry date (both on the visa and the passport), then there will be no problem... just be sure she renews it when she gets to the US.

It may have been a mistake at the embassy since she had her K1 approved in December, and her passport runs out in June 06, that gave her a full six months left on her passport from the day she was approved.

If we can, we will just renew the same day as suggested by James (thanks!!!).

Also Kezzie, could you clarify....are you saying when you came over to the USA your passport did NOT have 6 months remaining on it? Then you renewed it while still here in the states? If so, thats fantastic! Her father was making us feel that wasnt possible.

The passport must be valid during the period of authorized stay, which can be as long as 6 months for people from the UK. This provision which your future FIL states is for visitors. Since your fiancee will be staying in the uS, it would not apply.

Agree! Your passport must be valid for at least 6 months at the time of Visa issuance, so the Visa part is a non-issue. It is also a NON-ISSUE for her if she arrives in the country this weekend (2/17) with only 4 months left on her passport, her passport is still VALID.

The downside of having only 4 months left on your passport: nothing. Just that you have to apply for a new one in the US at your country embassy once it's expired. Again, Non - issue here!

I arrived in the States a year ago tomorrow and my passport was due to expire in June 2005 I had no problems at POE (and I was here as a tourist) on a VWP... we got married on April 9th and I downloaded the passport forms from the British Embassy website filled them in sent it off to Washington asking for my old passort to be returned as I needed the I-94 for immigration... I got new passport in my married name along with old passport within 2 weeks.... I took both passports to my AOS interview and had no problems at all...
