Specific Questions on Forms Adjusting from F-1

Hi Everyone! I hope I can rely on your expertise with the forms adjusting from F-1 for my husband (I am the USC). We have already put together most of the documentation, gotten the medical exam for him, etc. We have filled out the forms as per the guides and examples on this website. So far everything has been very helpful. However, I find that most of the examples are geared toward K visas. We are converting from F-1 visa as we are married now. I have done searches on this forum to find some of these answers but have not found what I was looking form. I have some specific questions forms I hope some of you can help me with.

Form I-765 EAD:

  1. Regarding item #10, I cannot find an A-number on any of his documentation so I am putting in his I-94 number. Those of you with F-1 visa, do any of you have an A-number, should I be looking for one?
  2. Regarding the "Which USCIS Office" item, the example form on this website left it blank but that form was geared toward K visa applicants. Since we are in California, should I list the California Service Center? I'm not sure what to put for "Dates" or "Results". Perhaps this section is not applicable but I'm not sure.
  3. Regarding item #16, I listed his eligibility c9 as shown on the example form on this website. After reading the instructions for the form this seemed most applicable. Would other F-1 previous applicants agree?

Form I-131 Advance Parole:

  1. Regarding Part #3, Processing Information, the section says to skip Part 7 after completing item 3 of Part 3. However in the example form on this website they have check marked 5.a. in Part 3 (after the part that says to skip to Part 7. The item 5.a. says to send the travel document to the address listed for the applicant. Is it ok to still check mark 5.a. of Part 3 but not complete the other sections?
  2. The example form on this website shows Part 4 of the form blank, skipping to Part 7 as Part 3 asks, but part 4 refers to "Information About Your Proposed Travel". Why would we not fill this out? I know we have to write a note about our travel for Part 7 (and have already downloaded the example from this website). Just want to make sure I should really leave Part 4 blank.
  3. Part 7 asks about one or multiple trips. We have one trip in particular we need the Advance parole for but worry we he might have to leave the country again before the green card arrives (to go to Canada to renew passport before February). Would we be safe than sorry to apply for multiple trips now just in case, although we have only one certain trip at this time?
  4. On the supplement letter for Part 7 the sample letter asks to put the A-number on there but we cannot find on his F-1 visa an A-number, should we include his I-94 instead?

Form I-130 Petition for Alien Relative:

  1. Regarding Item 14 under C. Information about your relative, the form asks for the I-94. When I plug in the numbers on his I-94 the number is shorter than the spaces given, is this ok? There are two spaces blank on the form. Also, his last entry to the US was not his original entry on his F-1 visa (due to a vacation prior to our marriage). Is this ok... that his last entry was not the first entry on his F-1? Furthermore, there is no expiry date on the I-94, just the D/S. I have written down the D/S as I read on another post, is this ok?
  2. Item 19 under section C (Info about your alien relative) asks for the relatives address abroad. He has been living in the US for over a year while attending school. Despite this, they still want an address in Canada although he is not living there now?

Form I-485 Adjustment of Status:

  1. Regarding Part 2 Application Type, it seems that none of these selections apply exactly to an F-1 visa adjusting status. The example form on thsi website chose selection c but that is for K visas. Should I select number "h" for "other" and explain converting from F-1? Or is the correction selection "a" since this application is going as a package with all the other forms in the hopes they will issue an immigrant visa number?
  2. Regarding Part 3 Processing Information, they ask for a Non-immigrant Visa Number, I am confused as to the correct number to take from the F-1 visa form. There is an Admission number that is all digits and handwritten, and then there is another number that begins with an "N" and followed by a lot of digits which is printed, not hand written.
  3. Also regarding Part 3 Processing Information, they ask for the Consulate where the F-1 visa was issued. There is nothing on the visa about a consulate. The only information about a location of issuance is toward the bottom of the visa where some school info states Los Angeles, CA. I'm not sure what to put for consolate in this area.

Hi, I am adjusting from F-1 and I will try to answer your questions as best as I can...

Regarding item #10, I cannot find an A-number on any of his documentation so I am putting in his I-94 number. Those of you with F-1 visa, do any of you have an A-number, should I be looking for one? The A# refers to your Alien Identification number. The only instance an F-1 student would have an A# is if he/she applied for Optional Practical Training in their field of study. The A# is issued with the one year work authorization card upon graduation. If your hubby doesn't have an A#, his I-94 would be fine.

Regarding the "Which USCIS Office" item, the example form on this website left it blank but that form was geared toward K visa applicants. Since we are in California, should I list the California Service Center? I'm not sure what to put for "Dates" or "Results". Perhaps this section is not applicable but I'm not sure. If he has never applied for Optional practional Training/employment authorization, then question 11 is "NO". Further, USCIS office, Dates, and Granted should all be "NONE"..those questions go hand in hand with 10 & 11.

I used the eight digits written in red, some people record the one with 14 digits

The only information about a location of issuance is toward the bottom of the visa where some school info states Los Angeles, CA. I'm not sure what to put for consolate in this area. The embassy in your husbands home country where visa was first issued.

Spice, thank you so much for your help! This will help me just about finish up the paperwork. I think on the I-94 the extra two digits I was missing were a pre-printed 20 at the end of the form so I'll include those digits on the form to make an 11-digit number. And on his I-20 form there is no consulate issuing information and there are three consulates in Canada so I'm not sure which one would have issued. I guess I'll try to research that further. But thank you so much! You were a HUGE help! :D

Can anyone else help me with these additional questions?

Hi I'm almost in the same boat...

I came here in the US on F1 status last 2006.

Met my husband in 2006 and got married in 2007. Husband was still a LPR.

We talked to a Lawyer and the Lawyer do the paperworks, but I we just knew that what he did was wrong.

Lawyer file I-130,I-485,I-765 eventhough my husband was still a LPR. We only got a NOA for the I-130 since then.

June 2009, my husband became a naturalized USC and updated the I-130. No response yet :(

What should we do? Do we also need to refile or update the I-485 and I-765?

I'm not quite sure what to tell you. I'm brand new at this whole thing and we just mailed off our AOS package last week. Can you contact the USCIS somehow and find out some sort of status? Maybe someone else with more experience will be able to respond.
