I am new to forum, so I wanted to say hello and with my first post I am looking for some answers for a friend. Thanks, in advance for your input.

Here is the situation:

A girl I met in Brazil. came over on a Fiance Visa with another guy a couple months ago. We have remained friends and stayed in contact via email and occasional phone calls since she arrived in the U.S. About 2 weeks ago, she called me crying saying that the ex-wife of her boyfriend beat her up with the help of her adult daughter. This was at a public event and the police were called and the ex-wife was arrested along with my friend's boyfriend. The boyfriend was arrested for hitting the ex-wife to get her off of my friend. My friend was hurt badly and she told me the police took pictures of her scares and bruises. My friend was at home scared because she has no one to help her out as she does not know anyone in the city or in the U.S. beside me. Since she lives many states away from me it was not much I could do.

She is in the last 30 days of the visa and now does not want to marry this guy, but she does not want to go back to Brazil. The boyfriend is apologetic and wants to marry her immediately. She wants to stay here so she will probably marry him just to get her documents.

I remember talk about a change of status of a visa if the woman was abused. My question is: Would this case qualify for her to get a change of status of her visa without marrying this guy????? Thanks for any help here.

Well I want to say thanks for all the input. However, a lot of you folks are pretty cold!!!!! I wanted some answers to the K-1 visa process because I did not know. I assure those cynics that this girl only had the intentions of marrying this guy for love. There are certain things that you can not know until you see them for yourself. She found out some things when she move into the house that you could not possibly know unless you live with someone. And I assure all of you "love conquers all" folks that you would be hesitant to marry into the situation either. She did not know this, and how could she until she experience living with him.

As far as me being the white knight, I am just a friend helping out a friend. I am sure she will go back if that what it comes to, but don't automatically come to the conclusion that this person is a scammer. She is not. Doe she want to improve her life--yes. So that does not make her some kind of visa fraud...no. Yes she would like to stay here, so I thought I'd ask the question.

I think upon reflection that calling her a scammer at the moment isn't correct since it was only sweetdaddys assumption that her friend would "probably marry him just to get her documents".. so what I said before stands but sweetdaddy you did not do your "friend" a favour by your assumption and given what you said you cannot expect us not to be irritated by it.

No doubt about it, because you told us her intentions before she ever said "I do". I predict she'll be calling a battered woman's shelter in 3 to 6 months, followed by a VAWA petition.

Not wanting to put salt in the wound, but already doing it. I am brazilian and I know the stereotype all too well.

The OP's post spells VISA FRAUD all over it. Girl comes on a K1 and oh noes, she doesn't want to marry him but she doesn't want to leave the US of A land of the brave so IF she can't just stay here legally she'll just marry the creep for the documents and kick his arze the second she's off the hook. The story is way too common. There are communities on Orkut for people like that, trying to find gaps in immigration laws that will fit them, oh, and they hate those who are "for real".

Sorry but VJ does not help people commit fraud, does not condone visa fraud, and the members will not support or give any advice to a person with those intentions.

All you'll get here is: Got a K1 visa and is not gonna use it? Go Home! And since of course she went ahead and married the guy, well, keep eyes and ears opened for a new thread on "Can I file AOS alone after K1 marriage fails?"
