I've been going over the I-134 and I'm wondering if there is any minimum requirements for finances. I've been reading all the forums and I'm not clear on the best way to fill it out. Some people are telling me not to put all my assets down and some people are telling me different things about my minimum pay needed. Any good advice on the total I-134 would be greatly appreciated.

If your annualized income for the current year exceeds the requirement then you do not need to fill in asset info.

If you meet the income requirements, you don't need to put all your asset information. I didn't and there was no problem :)

Some people are telling me not to put all my assets down and some people are telling me different things about my minimum pay needed. Any good advice on the total I-134 would be greatly appreciated.

Technically, the legal minimum for the I-134 is 100% of the US poverty level for your household size, which includes you, the foreigner you're sponsoring, and any other dependents you have. However, once you apply for AOS (i.e., the green card) then you have to submit the I-864, which is more legally binding than the I-134, and requires 125% of the US poverty level for your household size.

Consequently, many consulates that accept the I-134 will use the income standards for the I-864, which is 125% of the poverty level.

You only need to list assets if your income alone doesn't meet the minimum requirements. Assets can be used to make up the difference, but the rules are somewhat strict. The value of the assets don't make up for the shortfall in income on a 1 to 1 basis. Apparently, you need $3 worth of assets for each $1 of income shortage on the I-134, and $5 worth of assets for each $1 of income shortage on the I-864. You can only list the current value of the asset (i.e., what you could sell it for - not what you paid for it), and only the net value (i.e., what would be left after you paid off any loans or liens against the asset). You can't list your primary car, but you can list additional cars if you own more than one. You can list your home, but only if you have equity. If your mortgage is "under water" (like 1/5 of Americans who own homes) then the home is not an asset - it's a liability, and you should not list it.

A sticky requirement is that an asset can only be listed if you can convert it to cash in 12 months or less without significant hardship or financial loss. This means you can't list bonds, CD's, or retirement accounts if you'll incur a penalty for cashing them in.

thx for the info, Just making sure I'm doing everything correctly because it seems if you miss anything, it's not good. So many sad stories here and i'm over three months into it almost four and I don't want any delays. Waiting is the hard part anyway. So I don't need to fill all the info in if the amount is above the minimum?

Yes, waiting is the hard part.

And I filled out everything anyways. I think a good rule of thumb is that its always a good idea to over-do everything AND make copies of anything. :)

they don't really care how much you hvae in savings - as long as you make more then the minimum. $33k is enough for family of 5 or something.
