From my understanding of the situation the course of action is clear (as you are well aware by now) you must return to your country of origin and go through the legal process as we all have to.

The majority (I would hope) of the visitors to this forum are law abiding people who find themselves many miles from their loved one/s (partner, kids, other family members) for a very uncertain period of time - many of us are extremely stressed as a result and have bent (and will bend) over backwards to comply with the rules, therefore sometimes we're prone to snap at something which seems a little untoward.

I have my own (perhaps judgemental) opinions on your situation (from the little you have written) but see no sense in joining the pack and ripping shreads out of you - I hope you will do the right thing and fix your predicament as we've suggested, it may not be easy for your family but it is your only sensible option.

You have yet to tell us what your country of origin is despite having been asked several times, also how soon after your original fiancee backed out did you get married?

And can anyone tell me what a MENA man is (mentioned in this thread)?

Happily married (save for distance) since August 2008!

NOA1: (130) Received within 2 weeks of filing.

NOA1: (129) Received within 2 weeks of filing.

I-130: Processed at 6 months 16 days

I-129: (F) Processed at 6 months 16 days (day before my birthday thank you USCIS!)

NOA2: (130) Received 6 days after approval.

2nd July 2009 - NVC Received Case And Assigned Number.

10th July 2009 - Notification Received Stating K3 Package Sent To Beneficiary.

20th July 2009 - A One Sheet Letter Received With URL To Forms Required To Be Filled.

5th August 2009 - Medical Arranged.

14th August 2009 - Medical Taken.

27th August 2009 - IV-15 & Related Forms Signed For At London Embassy.

26th October 2009 - K3 Visa Interview - Approved! :D

December 19th 2011 - AoS Approved.. and sixteen Elephants fell from my shoulders.

I don't need to lie to anybody in here, you're not USCIS that I'm trying to convince you. If I told you about my lawyer, becuase you guys asked me, and I told you the truth. I blame myself why in 2 years I just spoke to this lawyer, and no I don't have any letter form her, she was in a different state. And yes I told her that I came with Fiance visa. And I'm saying this not because it's going to change anything, just for your information, after my wife got her citizenship, and we decided to have a lawyer in our city, and we were told we couldn't do it, we called her and said the other lawyers saying they can't, and she said no I can, and finally after us insisting, she said she would do some research and after that she didn't respond. And as you said blaiming her is not going to solve our problem

The reason that I share our problem with you wasn't that I was looking to stay here because we already know that I'm stuck in this bad situation and have to go back. I just wanted to know if someone had a similar situation and help me about what to do and maybe know how long it would take. Some of your answers were helpful.

Yeah, like others have stated it doesn't really matter what the attorney told you. If they in fact told you to break the law, if you didn't give the lawyer the whole truth to begin with, or if the lawyer for simply incompetant. Or, if you are lying to all of us to begin with.

This shouldn't really help your case in getting a waiver, but it certainly wouldn't hurt it: do you have a written letter/email from the lawyer that says the advice that they gave you and that you have since done? If so it would be helpful for us to see it (or at least for you to type it up for us) and I'd bring that along to show the embassy when you go home. Again, it's not specifically going to help your case. But it will 1. not be good for the lawyer who has cost you at least 2 years of your life, if not 10 more and 2. to show USCIS that you really weren't intending to break the law.

Now that your wife is a US Citizen, she can move to your country with you while you get your visa issues sorted out. So, there is no need for the two of you to part ways in the interim.

I don't understand why you said you didn't know about the k1 visa. When you get your visa, THE NAME OF YOUR PETITIONARY is there. When you enter the USA, the immigration officer stamped your I-94 and HE/SHE PUT THE NAME OF YOUR PETITIONARY over there. So that means, you must marry WITH YOUR PETITIONARY = FIANCEE = FUTURE WIFE.

Sorry but you have no choice but pack your things and go back to your country. It's a risk for you to stay here, and even worse if you dont work. Your wife can go to your country and live with you for a couple of years and file the CR1 (it depends on which country you are from).

My name is not on my husband's old K1 in his passport nor is it on his I94.

I believe it depends on the consulate issuing the visa as to how the visa 'looks' (some small variances) and, of course what happens at POE will vary widely.

The Obama administration is going to announce soon an Amnesty program for illegals. If I were you I would wait and not leave the US until details of the program are clear. Once you are legalized you can apply for welfare, food stamps, subsidized housing and maybe work part time as a community organizer registering democratic voters for the next election. Make sure you get a social security card so that in the future you can draw benefits. Dont worry about working, the American taxpayers will take care of you. You Sir, are entitled to the fruits of other peoples labor!

Since this is NOT about initial filing of an I-129F for a K-1, but a question about what to do about immigrating I will move this to the spousal visa forum, since this is the only option in this case.

In this case as others said, you are out of status, and cannot adjust based on marriage to someone other than the person who filed for the K-1.

If I had my guess, his wife is probably from the same country and it was all planned prior to his arrival on the K1. Best of luck working your way through the maze of immigration. I only hope the embassy that deals with you both helps you understand how people who commit fraud are dealt with!

I think it's fair to say since your wife worked for the 2 years and you didn't you can at least be together in your country while you work maybe you can then file and wait it out.

I just hope these two do not have children yet ...

Since he's put himself in a situation where he is staying here illegally, not working for 2 years and depending on wifey, I am assuming that he was not well off in his country of origin, which leads me to believe that the option for wife to accompany him to his country and work on visa from there may not be a feasible option.

If he leaves and there are children involved... poor babies living in a separated family because their parents did not think things through, were selfish or just plain ignorant or lazy to arm themselves with information about something so important as one's legal standing in US ...

I don't know, I just keep thinking and hoping that there are no children at this point ...
