Recently I received a letter from the NVC stating it had sent the I-129F (approved by USCIS) back to the USCIS, not stating why. I sent an e-mail inquiring as to why, and received the same exact letter of notification, with only the date being changed. The I-130 I had filed for my wife had been approved and is being processed by the NVC. While in the process of filing the Affidavit of Support, I called the NVC trying to clarify some questions I had, one of them being to include a signed copy of the Affidavit of Support for my step-son, without needing to include the supporting documentation. It was then that I found out that the I-129F had been returned because a block had not been checked on the 2nd page, even though all required documents had been submitted and the entire application approved (even to the point of assigning a "A" number to my spouse). I called the USCIS to see if they had received the returned form, and they gave no indication that it has been received, stating that it will take 120 days to review the petition once it has been received. It was at that point I filed a separate I-130 petition for my step-son. He was thirteen when Jenny and I got married August of last year and is now fourteen. My wife's process is nearly complete, all I need do at this point is send in the immigrant visa fee and wait for the rest of the process. However, she will not (and I am happy about this) leave China until her son's I-130 petition is approved and he is in the same stage of processing the she is currently. As far as I know, this has backed us up another six months minimum, and this is something I most definitely am not happy about. We have been in the process for nine months and and were hoping to be reunited this year. It does not look like that will happen now. Has anyone out there been through a similar situation? What steps did you take? Were you successful? Will the fact that my wife's I-130 petition has been approved help? We would like (wishful thinking?) that this will not delay us very much and they will be able to get their interview appointments together within the next few months. I have called USCIS and they old me to call the NVC. I called the NVC and they told me to call USCIS. Both claim to have no idea as to what can be done (if anything) to help this situation. I resorted to sending an e-mail to the consulate in Guangzhou and am waiting for a reply. Thanks for the time.
