you know on that interview checklist...it says :

they want to see the repayment plan or something like that if you owe any taxes...i owe the state not a big amount but i wont be able to pay it till my interview day which is next wednesday... ( due to my wifes unemployment she recently got laid off and still unemployed)...

Well - if it says you have to report them, and provide a re-payment plan - then that is what you should do.

Just make a statement acknowledging the back tax, and your plan to repay it at a later date.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

they will not bother to ask u so dont include anything that u owe tax

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. i dont think i mentioned that when i filed because my wife was actually workin by then and i personally never thought that would happen... anyway i hope they dont ask that...:)

They're interested in FEDERAL tax returns, but as far as I know, they never ask about STATE returns, which is what this thread started out asking about. I know in our case, we never gave them any information whatsoever about our state tax returns. Some states don't even have state income taxes.

So read carefully what they're asking for. If they're only asking you for information regarding federal returns, there's no need to volunteer information that they're not asking about.

But DO get that state situation straightened out as best you can as quickly as possible, on general principles. The state will eventually get their money, and if they have to go through garnishments, liens, and the like, it'll end up being more expensive than it otherwise would.

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

You shouldnt take a chance.....the question is "Do you owe any Federal, State or Local Taxes that are overdue". That covers all taxes that you owe. You can easily be rejected if they find out. I would suggest to get on a payment plan asap.

You just need to make a payment plan with IRS that is it. I did mine as I owe Federal. They can deny if you do not make any arrangements like installment agreement. It shows that you want to pay but you don't have money to pay and this can be happened to any body even IO can be in this situation so it is understood. I checked on N-400 that I owe taxes and today I got yellow letter that I should bring documents that I have some kind of payment plan.

my thing is I called the state tax office and they said they dont do anything like that...i just have to pay what i can when i can...thats all they said...they also said that they dont do any repayment plan or cant give me any status document...basically i dont know what to do...:(

Can they give you in writing? that they do not have anything like that and you can pay whenever you want?

when i call them they said they dont do anything like that...hopefully uscis would understand the situation...but any answers and opinions from you guys would be apreciated...
