Hi,

I just want to ask when can the CR1 visa holder file a petition for his son who is over 21 yrs old? He has been here in Hawaii for over almost 1 yr now.

File now as a LPR and upgrade the petition when you become a citizen. But wait is your son in Hawaii legally? As he is over 21 he can not adjust status as a immediate relative and needs to go back to his home country and apply. And if he overstayed then there are waivers etc that will need to be filed. Not sure how this works when applying for one of your children over 21. Can we have a little more information?

PS you are showing a K-1? Do you have your GC yet??

If he is in Hawaii, then the visa holder is no longer a visa holder, but is a permanent resident (green card)

Current wait for an LPR to receive a visa for an unmarried son over 21 is about 8 - 11+ years dependant on country
