Hi guys!

This might be the wrong topic to discuss here but it seemed like people here knows alot. This is for my cousin. She just got to hawaii together with her 7 yr old son last May of this year. She was petitioned by her US citizen parents. The father of her son is still in the Philippines but their not married. Can she petition her fiance even if she's only been here for a couple months and just starting her job? Or does she have to wait to become a US citizen after 5 years? They miss him so much already and thought maybe she could petition him without waiting that long. Please advise. Thank ya'll!

Since she is not married to him - she can not petition for a fiancé visa (only a US citizen can). If she were married - she could petition (I-130) but that will take quite some time.

If she has no plans to marry this man - she will not be able to petition for him at all.
