Hi,

I'm a conditional resident. I would like to remove my joint sponsor from the past i-864 i submitted. I'm re-filing the i-864. My husband finally qualifies the income guideline. On the website, it is unclear who I make the payment to? It states that I should pay to the Department of State. What should I write on the check? Do they accept personal checks?

If you are in the US, you do not need to pay for the 864.

You cannot remove the sponsor, once the GC is given. It's basically a done deal.

You could call USCIS, via infopass, to see what your options are, but everything that I have seen indicates you cannot remove a sponsor other than the ways listed (you become an USC, you work 40 qtrs, you die, sponsor dies, you leave the US an abandon LPR status)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I am in the US however, on the website it states differently about the i-864. Here is what is listed on the USCIS.gov website:

"Although USCIS does not charge a fee for this form, the Department of State does charge a fee of $70 when the Affidavit of Support is reviewed domestically."

I want to know if I should write the payment of the check to : "Department of State"

Furthermore, I want to show that the petitioner has sufficient income. 2 years ago during the interview, I specifically asked to the officer that reviewed our application if I could make the petitioner the sole sponsor. She told me that it's fine as long as I submit another i-864 to them.

You cannot remove the co-sponser once a green card has been approved. You are SOL.

AOS Process

May 29th 2008- AOS/EAD/I-130 Sent to Chicaogo Lock Box sent via Overnight Delivery

June 6th - Both checks cashed!!

June 25th - Biometrics appointment

Sept. 19th - Card Production Ordered! (113 days since filing)

Sept. 25th - EAD Received!!!

Dec. 5th 2008 - Received appointment letter

Feb. 4th 2009 - AOS Interview (Interviewer says going to recommend for approval)

May 15th- called and talked to an officer to submit a service request

June 10th- Made an infopass appointment,

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

May 27 I-485 Approved

June 13th 2010 - Green card received!
