Hey everybody, I'm new in this forum and I had a problem in my I-130 application with a concurrent I-485 and I-675.

Last Friday I received a letter from the USCIS saying that my process was on hold due lack of initial evidence.

It says:

Form I-684 was submitted; however it wasn't from the petitioner/sponsor

In order to process your application further, submit a completed and signed form I-864 for the petitioner/sponsor listed on Form I-130.

In order to process your application further, the joint sponsor on form I-864, must submit all supporting tax documentation (w2, 1099s, etc) submitted to the IRS for the most recent tax year.

The joint sponsor on Form I-864, must be a US Citizen, US National or a Lawful permanent resident of the US.

I basically know where I screw up in my application. I sent only the joint sponsor form and didn't fill one for my wife that filled the I-130 for me. So now I'm gonna fill it up and sent it to them.

But I still having a few questions about what I have to do.

First: My wife doesn't work. She is a student and we cannot prove any income from her. So on section 6 question 22 of the I-864 How should I answer about her profession? Unemployed since birth? I can also submit her parents 2008 tax papers and there she is a dependent.

Second Question: When I sent my applicantion I sent a I-864 from My mother in law who filled it as a Joint Sponsor. The thing is that she lives in Fairbanks - Alaska and till she gets all the documents they are requiring and send it back to me it may be too late. My uncle who lives next door wants to do it for me. Can I send my wife's I-864 and fill another joint sponsor I-864 with all the supporting docs and send it to them? Is there any possibility of it getting rejected?

Another problem!

She never filled a tax return. on Part 6 n 25 the only options I have is to send last year tax or the last three years!

what should I do?

send her parents last year and underline her status as a dependent?

She needs to fill out the I-864. Her occupation is "student", her income from that occupation is -0-. Attach previous years tax returns which claim her as a dependent for her obligation to have filed tax returns.
