2003 Drug arrest...

Hello everyone!!

I'm helping someone do a K-1 and her fiance was arrested and put in jail for smoking pot in 2003. He works at a resort now, which I'm surprised they would hire him with an arrest record. Anway, does anyone know if this will disqualify him from coming to the U.S.? Any words of wisdom from someone that has been through this would be much appreciated.

He lives in Jamaica, if that matters.

You're surprised that they would let him work in a resort after having been arrested for smoking pot?? In JAMAICA???

Ok, nevermind.

Normally, an arrest for a "controlled substance" would make him inadmissible under 212(2)(A)(i)(II). However, there are two exceptions:

1. If he was under 18 when the offense occurred, and it's been at least 5 years since he was released from jail.

2. If the maximum sentence for the crime was 1 year or less in jail, and he was sentenced to 6 months or less.

If either of these exceptions apply, then he is probably admissible.

I think it can affect things - check in the Regional Forums or one of the Yardies threads - they can probably better break it down (how/if to overcome this hurdle).

Thompson2B....have him get a police report done then she'll know what's on it and take it from there. Her fiance knows what to do on his end.
