Effects of MEdicaid /WIC

Hellow fellow vj members,

I would appreciate if someone can give me an idea if this is a good thing for us to do ?

My hubby lost his job and we are planning to apply Medicaid and WIC for our USC baby. We are on the process of getting my 2 kids from the Philippines(waiting for I-130 NOA2). and will be removing my condition on the first week of next month. My question is..if we apply for medicaid and WIC does it affect our 2 applications if ever?

Pls,,any ideas will be appreciated.

If I am not mistaken, both are federal means-tested benefits, and unless you've been in the USA as a PR for 5 years, you are ineligible.

I believe you could get medical benefits depending on your State gov. I believe definately you have to be here for a mimum of 5 years to get any food stamps or welfare benefits. Be careful applying for federal benefits when you have applications

pending in immigration. Your husband signed affidavid of support, and based on that they could think your family could become a public charge.

Thats a tough situation. Think this out, and Good Luck.

Thank you,,that is why i asked this to make sure.The medicaid suppose to be is for our baby born to our marriage and the baby is a US citizen and not for me coz i know i am ineligible.

So if it's for the baby is he not eligible since he is a US citizen?

I'm a new at this visa stuff but I have done a little research on this subject. WIC is not a means tested benefits like Food Stamps would be. The baby and you, if your still nursing, should be able to get it no problem. The income for WIC is higher than the 125% poverty level ($32,560 for a family of 3). As far as Medicaid goes, your baby and husband could get it if they qualify, not you though. Also according to the instructions on the I-864, this should not effect the sponsorship, it just can't be used as income on it. Here is that link, it is on page 3.

Oh also Emergency Medicaid is not considered a means tested benefits (like if you had a horrible accident or a stroke or something). Also here is the link that talks about that and other benefits.

Previously at one time, my husband, myself and my baby daughter all had received medicaid and also WIC.

My husband arrived on CR1

This did not have any effect when we removed conditions.

06/13/09 - received letter in regards to my inquiry to Customer Service - stating husband had recently missed biometric appointment (never received a notice in mail) - going to be rescheduled - letter dated 06/05/09

06/17/09 - received Notice for biometrics appointment - dated 06/12/09

06/26/09 - Biometrics Appointment - St. Albans, VT

08/20/09 - Received Interview Appointment Letter

10/05/09 - Interview - Albany, NY- PASSED

10/23/09 - Oath Ceremony - Fort Edward, NY

01/28/10 - applied for US Passport

02/19/10 - received back naturalization certificate

Yes, that is true because at the rmoval of conditions stage the I-864 is already in place. In the OP's case, they are at the petitioning stage and will have to demonstrate the ability to support the children above the poverty guideline threshhold.

WIC is not a means tested benefit as far as PRWORA (Personal Responsibility and Work Opportunity Reconciliation Act of 1996) goes. And you can make up to 185% of poverty level and still get it. There are only 5 means tested benefits in regards to PRWORA and they are:

Social Security Income (SSI)

Food Stamps

Medicaid

Temporary Assistance for Needy Families (TANF)

State Children’s Health Insurance Program (CHIP).
