Hi Everyone!

It's been a while since I've visited the forums, I hope you are all doing well.

I have a quick question. I am nervous about filing for the removal of conditions and I want to make sure I get my filing date correct.

If my Conditional Green Card expires on 9/29/09, that means my I-751 must be sent by 6/29/09? I am freaking out a bit because I am very busy at work and I don't have the IRS transcripts yet- can I file a week late or does it have to be postmarked by 6/29/09?

Hi! Good to see you again. If your conditional green card expires on 09/29/2009, your 90 day window opens on 07/01/2009. You can file anytime during those 90 days but don't file before 07/01/2009 (if you do they will return your application and you will have to re-submit it). Good luck! Silke

Silke, thank you! That makes me feel better. I will request the information that I need and file the first week in July. I was worried there for a second!

Maybe you can help me with another question- do you know who you can use for the affidavid? Can you use your parents?

Yes, your parents can write the affidavits. We submitted one written by a friend and another one written by a family member. You could also ask a neighbor or a co-worker. Hope this helps.

Just thought of another question, hopefully someone can help. For removing conditions, do you have to submit a passport-style picture like you did with the adjustment of status?

Like silke said, don't file before 90 days. file around 89 or 88 day, but don't file after your GC expires as you will be put into deportation proceeding.

If you gonna file bit late file at least 50-60 days before your GC expires, the reason is because, if USCIS send your application back due to some reason

you have ample time to resend it. Also you want to give yourself sometime to get NOA (which application acceptance receipt plus extension of work and stay

for 1 year). NOA can take 1 week to 1 month depending how busy USCIS is. So better be safe than sorry.

I have a question for you, and I hope you or any member can help me too.

Today i received a letter from USCIS a notice of requirment to file joint petition to remove the conditional basis of an alien's permanent resident status. My green card actually expired on 10/12/2009.

Can I file now or I have to wait until July 12, 2009?

Actually I was surprised that I got the letter, I asked all of my friends they never get this kind of letter

Please help me.

Can I file now or I have to wait until July 12, 2009?

You need to wait till July 12th. If you file before start of 90 day window till your GC expires, USCIS will return your application.

Hi! Good to see you again. USCIS has started to send out reminder letters for removal of conditions. Does your reminder letter say your 90-day window opens on 07/12/2009? I'm asking because if you subtract 90 days from 10/12/2009, the new date is 07/14/2009. So just to be on the safe side I would wait until then to submit your application. If you submit it too early, they will send it back to you and you will have to re-submit it. I hope this helps. Good luck! Silke
