Do I Still Need Co-Sponsor if I Exceed Poverty Guidelines?

If I exceed the poverty guidelines, is there still a chance that they could ask for a co-sponsor or do I not need to be concerned about that? The reason I ask is because I am not a multi-millionaire... I'm an average American woman that leads a simple but comfortable life & makes a bit more than the 125% poverty line for myself & 3 kids that I share 50/50 with my ex.

The household size for the affidavit of support is you+fiance+any kids coming with fiance+any dependents on your last tax return. If your income exceeds the requirement you should be ok.

Thanks! He doesn't have any kids... do you know how they would handle my 3 kids since my ex & I split them 50/50 time-wise and I don't receive child support? I exceed the 125% based on a family of 5... but of course the # looks much better when you consider the children are shared equally with my ex.

Thank you for your input.

If you claim them as dependents they are considered members of your household. If your ex claims them then they are not in the calculation. Whatever is on your most recent tax return. The time with each parent is not a factor.

You have been a big help, thank you! For tax purposes, he got to claim all 3 last year, but from here on out he claims 1, I claim another, and then we alternate years on the 3rd... not that you care, necessarily :) but you have at least calmed my nerves about whether I need to start looking for a co-sponsor or not... but if I exceed the 125% on a family of 5, I def exceed it for a family of 2... so thank you, thank you

Yes, income plus child support really makes a difference on the income guidelines!! It saved me big time cause I just barely made it with that added on my income...whew..relief!!!

You are almost there and now you have to deal with the embassy. This is the place to post your experiences or questions related to this last step before moving to the US. Topics relating to I-134's, packets sent from consulate and medical & police certificates should be posted here.

YMMV
