Hi my vj family.

Two weeks ago I went to SS Office. I was advised they can't issue me ss card because immigration has spelled my name incorrectly. The SS officer has sent letter to immigration requesting to correct my name. This morning, I pay a visit to SS Office to check if everything went good. To my surprise, immigration hasn't doing anything. And so my application for my ss card is being pre-empted. Now, SS officer advised she will send letter AGAIN to immigration.

My concern is my I-94 will about to expire on July.

I called USCIS Office and brought my issue. Sad to say, the USCIS officer said that she can't do anything about it. All I need to do is go directly to my USCIS local office via infopass. What exactly is INFOPASS? How will I go about this?

I will appreciate your brilliant ideas and advice.

When in July does your I-94 expire? You are only 9 days from July (counting from Monday) It better expire July 6th or later or you are SOL on getting an SSN or card now based on your K-1 status.

SSA is not correcting your name. Since I assume the name that comes up in SAVE isn't spelled the same as it is on your I-94 and they are trying to verify that your are the same person. Do you know how misspelled your name is, since if it's only one letter, they can go ahead and process the application?

It sounds like they must have sent a Form G-845, but did they try the secondary electronic verification before sending the G-845?

Depending on when your I-94 expires, it could be too late to do anything about it.

Go to Social Security. Apply for the card in your name exactly as in your passport. After your AOS is complete (with the correct spelling on your Green card) go back and change it with SS. How your name is spelled on the SS card means absolutely nothing. When you get the card you will memorize the number and put the card in your sock drawer. The name that is printed on the card couldn't possibly matter less. I LOST my card 35 years ago and haven't needed it since, it could say "Santa Clause" for all that matters.

USCIS will not do anything about it. Do not be surprised. You need to get your SSN 14 days before your I-94 expires or wait until you have your green card.

I will also state what I alwasy say...K-1s need to apply for their SSN before you unpack the suitcase. Next day after arrival is best, ALWAYS apply exactly in the name on your passport.

The name that is used comes off the immigration document, i.e. I-94, not the passport and obviously what was keyed into SAVE doesn't match the I-94.

How your name is spelled on the SSN record is important in that you have to use that name to work and file taxes and if you apply for a driver's license that's the name that you will probably need to use for that too, since most states compare the application name against the SSN record.

C. Procedure - Immigration Document as Evidence of Legal Name

When issuing immigration documents, the Department of State and DHS issue them in the person’s legal name. The legal name is also generally the name in which the foreign passport was issued.

When an alien applies for an SSN card, presume the name on the immigration document is the legal name unless the applicant presents evidence of a legal name change (e.g., marriage) that occurred after the immigration document was issued.

In cases where an alien applies for a replacement SSN card and submits an immigration document showing a name that is different from the name on the prior Numident record, accept the immigration document as evidence of the legal name. In these cases, the prior SSN card may have been issued in a name that was not the NH’s legal name.
