Hi folks.

I'm on a student visa (F-1) and getting married to a US citizen next august. I'm quiting school june28th. My question is, would i have to submit the I-130 and I-485 before the 60 days past june 28th? what would happen if i submit those later than 60 days after finishing school? In the latter case would i have to file i-485 supplement A and pay the 1.000 for being out of status??

I am new to this, so forgive me if this has been answered elsewhere. What is the source for your 60-days figure?

Well, there is a 60 day period after your last day of classes. Then you need to either transfer to another school, change status or leave the country not later than that date. My expiration date in my I-20 is August 30 but since i;m quiting school on june 28th then the last day i'd be in status woul be the 25th august.

Ok, so the 60-day figure is specific to your situation due to the status you hold. That's good to know, i thought there was yet another detail I was missing lol.

Good luck dude. I call you dude coz I assume you're male, else you'd be latina lol.

As for your original question - I am new to this so my handle on the facts are a little shaky but I believe you can be out of status for a short amount of time before the penalties kick in. I will let the experts say how much that short amount of time actuall is.

A short period of out-of-status (or overstay) is generally inconsequential (shorter than 180 days that is). So, you should be perfectly OK. Just don't get caught in anything - keep your nose clean for the next few weeks. Good Luck
