me and my wife have a possible august interview but it is not yet assigned if i plan a flight there for early august and want to extend my stay is there chance they would refuse my prolonged stay if i file for extension?

My husband wanted to stay past the 21 days allowed, so he had to call the Philippine Consulate General first in Washington DC (capitol USA) to get the number of the Consulate that serves his area. Then he called and got a website to download an extended stay visa form, mail to them with SASE along with money order for $30 and his passport. In 1 to 2 weeks he gets his passport back with the visa inside, he can now stay up to 59 days. IF he is going to stay past the 59 days, just go to the US Embassy here in Philippines 1 week prior to the 59 days for extension.

It's not that hard to do, I did 5 times when staying in the PI. just before your 21 days are up go down to the PI Immigration in your province pay the waiver fee. It's over 3000P. Now days you will have to go back later to pick up your passport (sometimes the next day) cuz a new check they do on you to see if your on a hold departure,blacklist, watchlist. After you get the waiver its good for 30 days really it's very easy to get it when your in the PI.

Aliens admitted under E.O. 408 (non-visa required nationals admitted for 21 days) may extend their stay in the Philippines beyond 21 days by applying for a visa waiver at his nearest Immigration Office before the expiration of the 21-day period. This will entitle him to stay in the country for more than 59 days, he should secure extension of stay and register with the Bureau of Immigration, and pay the necessary Immigration fees.

What is the maximum extension of stay that can be granted?

Foreigners holding temporary visitors visa pursuant to Philippine Immigration Act of 1940 and aliens admitted under E.O. 408 may extend their stay in the Philippines every 2 months for a total stay of 16 months. Extension of stay after16 months, up to 24 months need the approval of the Chief of the Immigration Regulation Division. Extension of stay after 24 months need the approval of the Commissioner. (MCL Memorandum dated 31 July 2007)

I'm looking at my offical receipt 3,030P don't over stay with out the waiver they can ding you with a fine at the airport when you depart.

Well my husband only had to pay $30, that is not even 1,500 peso, less than half of the 3,030P you had to spend, and my husband value his time so he just mailed his passport prior to coming to Philippines, so it is half the cost and already approved for him to stay the 59 days. He did it this way so he will not have to waste time or money once he is here. Either way is possible and will be approved, but as stated, because of the checks they do now, you have to leave your passport and go back, that is 2 separate times to go, where as my husband only mailed one time and wait 1 week for them to mail it back. IF you live near a Philippine Consulate General Office, you can go personal appearance in US and they do that on the spot. My husband is 3 hour drive so he mailed his.

The OP was saying A Possible Aug. Interview and was asking would they refuse his prolonged stay? I take that as if, he's in the PI... he's not sure if he even needs it? Sooo why wast your time and money if you don't need it but if he's in the PI and finds he needs to stay longer he can get it that's all I'm saying!

nah, hubby filed for extension even before we got married... they will charge you a lot though.. like i think less than US100.

Hello SJR09! I saw your timeline and you got the NOA2 for both visa at the same time! May I know what did you do to go for the CR-1 instead of K3? I believe that there is a different process for each visa. Can you give us assistance? We are planning for filing the K3 as well but still searching for the risk.

your I-129f is the key component ie visa for K1, K3 and CR1/IR1 so you only have (one visa) not two. You will file I-129f after your I-130 NOA1 then after I-129f approval, at that point you can keep the K3 or go with the CR1 the K3 is faster then the CR1 but less benefits ie AOS EAD and cost. go thru the links and read. With the CR1 your wife will have green card and can work in about two weeks.
