I would think if she explains to the embassy that the jerk was cheating on her (and she no longer wishes to do the K-1), they would probably take that in consideration.

(she should even go to the interview if it comes in - to explain the situation at that time!)

I mean, why would she be made to suffer if this guy doesn't withdraw the petition in a timely manner (or why should she be forced to wait?)

Now, the OP would still need to qualify for the student visa. Hard to say what the consulate would think. So, again, I would try to inform them myself of what is going on with this K-1.

Can she accomplish the same by just failing to show up? It is her interview, right? No interview=no visa.

Ok, somebody correct if I'm wrong in my understanding about this...

HE petitioned on her behalf, so only HE can withdraw the petition, correct?

Ok, if he does not withdraw the petition, then SHE is authorized to apply for the visa at the foreign consulate, correct?

If SHE is the one applying for the visa, can't she simply withdraw the visa application? This won't cancel her permission to apply, which was granted by the USC's approved petition, but it should cancel the visa application process, right?

Alright, if the visa application is canceled, then the visa petition should expire within 4 months, since it won't get automatically renewed by the consulate, correct? Wouldn't that remove any limitations on the foreigner applying for another visa?

Or, am I misunderstanding something? :blush:

I think you need to focus on your future. Depending on what field you are in, a masters in the USA may not be the best idea.

A master can cost you anywhere from 25k to 50k per year. In a 2 years program that is 50k to 100k. Plus you need to add your room and boarding cost. On the cheap side you are talking about 14k a year. (House, food, books, spending money). In a 2 years program that can take you to 78k to 128k.

Once you are on a F-1 visa you cannot work. (Well you can work in the school like teaching assistant etc, but you won;t make much). Moreover, after you are done, you still have to deal with h-1 visa etc etc.

Moreover you will leave home for more than a year. After you do that you are poisoned. YOu will not feel home anywhere. YOu will always miss something.

There are very good masters in Italy, and they are cheaper compared to the one in the USA. Unless your family is very rich, I do not recommend you go through this hassle.

Most likely you want to do the master, cause you want to show him, or maybe even because you want to get back with him. Do not do that. Let a year go by and then if you still think that a master is a good idea the go for it.

I did all of the above... and I do not recommend it to anybody. I got involved with the USA again because of my girlfriend. But I would not go back there if I had to go through f1- h1 etc.

I don't think there would be any.

The K-1 petition only gives the person being petitioned for, the ability to apply for a visa, if that petition is approved. They then have to be approved for that visa. The benificary can stop this application process anytime they wish.

It doesn't hold that person to actually take the visa. For that matter, it doesn't force them to actually travel to the US if they change their mind. The OP can simply go to the interview, explain it, and the consulate would most likely pull the application paperwork, and send the petition back to USCIS.

I would think the embassy would see it as a good thing if the beneficiary comes right out and tells them what is really going on.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Unfortunately I didn't get prepared for this horrible situation but I always thought that both petiotioner and the foreign can withdraw the case. Please if you have info. I would really love not to ask him anything like cancelling for me the visa.

You don't have to ask him anything, the petition will die of old age after 4 months. If you do not apply for a visa it will be dead. This will not cause you any problems.

Thanks again for replying, I know the master is a little bit expensive but that's a project I had prior of my engagement with the man I like to call #######.

What I am concerned now is the time.

I don't want to wait an other 3 months for my petiotion to "die" in the consulate. I would like to start moving from now. I don't want to give up my dream just for a stupid human being.

I will have to call him and ask him to cancel my petition. If that's what I have to do I will do it.

Anybody has any idea of how many chances I will have to obtain the student visa after all this mess?

Hello,

I hope I will find some support in this forum. I wish I found this forum earlier but everything happen for a reason.

Since I have been knowing my fiancè I knew I would have married him. Well, I was wrong!

We are at the almost end of the k1 visa process (the consulate received the petition) and I found out he has an other woman.

I am crying, I am upset, I hate him but I have to move on.

I cannot give up my dreams for a #######.

I was going to spend my life with him and now.....

We were planning for me to go to college to do a master and then, hopefully, with a good job, have a wonderful family.

Now I don't want to give up my dream. I want to study in the US and I want to show him that I will do it with or without him.

Guys, do you think at this point I can withdraw my K1 petion and apply for a student visa?

I am very confused and I know at some point I will be weak but I will never forgive him and I don't think I have to pay the price of my future (a great master).

Please help me

It is really your choice. Have you enough proof that he is seeking someone else? it could just be a good friend. I do hope you let common sense prevail and not make any hasty decision until you have all the facts together. We all need forgiveness sometimes. Have a wonderful day. :thumbs:

The petition approval is good for four months from the time it was approved (the NOA2 date). Unless it's extended, it will expire automatically. I don't know when your petition was approved, but if the consulate already has it then I'm guessing it's been at least a month or so. Some consulates will automatically extend the petition for another four months, so you should contact them right away and let them know you won't be submitting a visa application.

You COULD try contacting your ex-fiance, as you suggest. Even if he cancels the petition, it's still possible that it won't actually be canceled in the USCIS records before it expires on it's own, especially since the petition is already at the consulate. USCIS isn't known for moving particularly fast.

I'm a little puzzled why you would think 3 months is too long to wait. Have you already applied to and been accepted by a university in the United States? Do you have your SEVIS form? If not, you still have plenty of work and time before you'll even be able to apply for a student visa.

waiting for paper transfer and the good word

OCTOBER 14TH 2005 Interview Number 2: ISLAMABAD, PK

AR number 2 sent to DOS per Islamabad (2 cable request)

Nov 22 okd updated financial and etc proof accepted / embassy waiting for security cables

dec 20th one cable back waiting on 2nd

Jan 17th.. good word recieved. SECURITY CHECKS ALL CLEAR!!! DOS says embassy to contact him within two weeks!!!!!!

FEBRUARY 10th, 2006 VISA RECIEVED!!! They called him In via phone, stamped his passort and sent him on his way!!!

FEB 28th WELCOME HOME>>>POE CHICAGO did not even look at xray, few questions. one hour wait at Poe

march 10th marriage (nikkah at the islamic center)

aug 2006 AOS interview, cond 2 yr GC arrived september

June 2008 applied for removal of conditions on permant residency aka awaiting for 10 yr greencard

Dec 2008 10yr green card approved, no interview.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
