Hi everyone

please need urgent help!!!

My friend came to US on student visa in December of 2008. He did not went to his school and abandon the studies. so he lost his student status. Now he found this girl online, she is US citizen and they got married on June 3, 2009. So now what is the procedure to become permenant residence? Is he going to have any problem because he left study? how long the process of getting green card is going to take? do we need to fill I-130 or I-485 for adjust status?

So he was in the US for 6 months on a student visa but he never went to school? And he 'found this girl online' and they got married? Did he find her before he came to the US on a student visa?

No he found her after coming to US withing that 6mnts period?

I can't speak to the losing student status, but he could try to file for AOS from marriage to a USC. If he didn't have immigrant intent when he entered the country, which would be his burden to prove, and the marriage is valid, then it's possible he could successfully adjust status. It's been done before. You might direct your friend to the guides on adjustment of status.

Here's How I see It. The IO's are far smarter than me since they deal with such cases in thousands. He came to the US on an F1. Countries like ours are not in the USCIS's good books to begin with. He never went to School. Why did he come here if he wasn't interested in his education. He definitely had ulterior motives and an intention to do exactly what he has done now. I would suggest, he goes back and tries for a Immigrant visa from his home country. Having said that, best of luck.
