Hello,

actually my friend is citizen and she filled for her parents i-130 they are in U.S.A. on B1 or B2 visa so can they stay in U.S.A.? or they haev to go back. also her mother's visa is expiring in 2 months and she just filled last week so what is the time period for USCIS to reply or get approve on the i-130

if anybody know the answer please help us.

They would need to file for Adjustment of Status (I-485) to be able to remain in the US. This should have been done along with the I-130 but it can be done now by including a copy of the NOA1 along with the AOS application. You do not need to wait until the I-130 has been approved.
