apparently the OP is indicating that the application of the criteria is "racist". i would guess the applicant is indian.

india is considered a high fraud country. this based on USCIS experience with indian petitioners. also based upon difference in ethic between the countries. in the USA, you marry someone you "love". in india, you marry someone who can advance your position. different purpose for use of the same mechanism. of course, both factors may come into the mix in either country, but the predominance of selection is what it is.

A marriage does NOT have to have "love" to be legally legit. A lot of people DO make it thru the consulates in India because the staff is trained in recognizing traditional marriages. And, with certain groups within India, the marriages are about advancing your position or maintaining your position - and they are regardless if immigration is in the mix or not!

There are agents in India who can stage a courtship/wedding that crosses off every thing the CO wants to see. The fact of the matter is that "love" alone at Indian consulates means nothing. If you haven't done every "cultural" thing that the CO is looking for even though the two of you are in love - you're toast.

the OP indicates that the couple was denied because it appeared that they were closely related, so thereby not suitable marriage partners. in this case, indian custom and American law both apply. even if it were acceptable for cousins to marry in india, laws of the state in USA in which they intended to get married must be considered.

And they are not related by any means, cousins, far cousin, closed relatives, that's why they wonder if she should take a DNA test and send it to the consulate, a sensible thing for the consulate to do.

In certain family cases like father/mother filing for they child and vice versa, i think part of the process the consulate would order a blood test. maybe they were a little bit harsh with the racist comment but to say too people look alike therefore they must be related without any proof, DNA or blood test, what would make the consulate come up with that decision?

Prior to this curve ball by the consulate before the the rejection of the appeal, they were planning to go there and get married then file for CR1 or K3 not familiar with that route, but now they have to deal with that accusation 1st.

I read an article one time that people are naturally attracted to people that look similar to them. Something about how we naturally gravitate to those that look similar because that is what we are used to seeing...then again, that really doesn't apply for a lot of us on VJ! I'll see if I can find it.

I don't know. I think that if the couple plays it right, they could get past this. Like someone mentioned before, they should send out this little piece of "news" to anyone that they think will listen and get the congressmen involved. Firstly, they should go to a well-known trusted doctor (how about the one that the US consulate recommends on their website) and get a DNA test. Then, include the results of that with all of their letters to EVERYONE saying what happened.
