can tourist visa be used while applying for other visas

My fiancee have been traveling back and forth from us to peru for the last 8 months. My fiancee currently has a 10 year tourism visa. We want to get maried and get her a green card. Can we file for k-1 and still use her tourism visa to stay here and travel back and fourth. Or does she have to stay in Peru once we apply for k-1. What if we get married in peru? Could she travel back here whil ewe wait fo rk-3 on tourism visa. Because she has a tourism visa do we need a change of status? We dont want to take any unnecesary chances but we prefer to stay together as much as possible. any advice would be apreciated. Also how long can she stay on tourist visa?

Visiting while in the K visa process is possible. She just wants to be able to show strong ties to home (house, job, etc.). Visiting Tips

If you marry before you start the process then the CR-1 seems to be the right thing. Fewer steps, less in fees and she would have a green card after arrival in the US.

Violation of TOS by recommending an illegal action. You can't just come and file or no VWP countries would do K1... Only way to do what you are proposing is to spontaneously decide while in the US that you wish to marry and you are responsible for proving that. Yes, some people get away with it, but some don't and face bans for re-entry to the US.

ok what if we get married in peru next month. Then we apply for CR-1 or K-3, and green card? my question is

A: can she still travel here on her 10 year tourist visa?

B: If she comes and visits for a month at a time than goes home for a few weeks is this okay?

From what i think i understand from what people here are saying is the process takes maybe 4 months or so. she has a brother who lives in chicago (I live in connecticut) so theoretically is there anything wrong with her spending a good portion of that waiting time as a tourist? I don't want to circumvent the rules and procedures but if it isnt risky we would love to be able to spend as much of the time together as possible. we are new to the visa Journey process. My fiancee had a 10 year visa that expired last year. She renewed it so there is 9 years left on it. Because she had one before and was renewing it i was thinking that would show her intent was not to get the tourist visa just to marry a gringo. , lol.

I just am unsure of exactly what constitutes a fraudulent use of the tourist visa. Does being engaged or married all of a sudden change the nature of her tourist visa? if she does not overstay the tourist visa have we commited any fraud?

heres a specific example of what i am confused about.

My fiancee came to visit me june 3rd of this year. when she arrived she she got a stamp on a department of homeland security form that sais she could stay here until november 30th. So is there anything wrong with her staying here while we apply for a K-1? We really want to make sure we don't do anything that would jeapordise her ability to stay in this country.

We are at the very begining of the process and really just now trying to formulate an exact game plan. I have been told that this site is a great resource to start with and any help is tremendously apreciated!

I'm not 100% sure of how that would work. There is nothing wrong with her using her tourist visa when you're applying for the k-1, and other people have come visited during the process. It isn't against the rules to come to the US as long as she doesn't overstay. It's isn't fraud either because she's using the visa to visit family and friends. It would only be fraud if you did what the previous poster said about getting married in the US with the tourist visa, and that's even questionable. Totally depends on the immigration officer at POE though.

As for the K-1 process, your fiancee is going to have to spend a good chunk of time in Peru getting the medical exam done and gathering all the necessary documents together for the interview & to attend the interview. I really recommend going to the interview with her as well.
