J-2 going to Canada with expired Visa

Hello Everyone. First of thanks to everyone for helping others.

I am one of those NSEERS registrant. I would be visiting Canada in july for a couple of days only. But my J-2 visa ( in fact my spouse J-1 as well) would be expired at that time. However our J1/J2 Visa Status wont be expired at any moment ( its valid till JUNE 2010).

My questions are as follows:

1. Being the NSEERS registrant, Do I need to hand over my I-94 at the US Airport before departure. Usually what I know is that if you are visiting Canada or Mexico then we dont need to hand over I-94.

2. Automatic Re-validation of Visa: Does any one know any problems that might happen during re-entry to US for NSEERS registrants. ( remember I would be re-entering only after couple of days, and I would only travel to CANADA.

Regards,

CB>

If you need the Canadian visa plan ahead as it takes at least 10 business days to get it. Having US visa does not mean Canadians will let you in.

If you have the I-20 (or DS 2019 I think that's the number) that shows you're in good status then you should be fine returning. You will get a new I-94 again with D/S note as before.

I don't think so. The OP has two complications - NSEERS and the automatic revalidation of the Visa.

OP- You should have been given instructions, follow them. There are a number of sites on the net that give info for J-1 holders. But - how this interacts with NSEERS, I don't know, and how being J-2 might change this I don't know.

SHORT TRIPS TO CANADA, MEXICO, OR THE CARIBBEAN ISLANDS:

If you intend to visit Canada, Mexico or the Caribbean Islands for less than 30 days and the J-1 visa in your passport has expired, you do not need to obtain a new visa for re-entry into the U.S. This process is called Automatic Revalidation.

As you leave the U.S., do not surrender your I-94 card (Arrival-Departure Record), which is stapled inside your passport. Instead:

* If you are flying: Make a photocopy of your I-94 card before your departure. Present the photocopy of your I-94 card and show your round-trip ticket to the airline attendant.

* If you are driving: Present your documents and explain to the port-of-entry official that you are visiting for less than 30 days and that you need to keep your I-94 card. At your port of re-entry to the United States, present your passport, your DS-2019 form, and I-94 card.
