I will be getting married soon to my fiancee who is here in the US on a work visa. I've been reading the Guides and here is my first and perhaps most important question. Does it make sense to wait 2 yrs after marriage (we're getting married in the US) to file for adjustment? She is legally here right now and will be allowed to be here in 2 yrs unless the job falls through (which it won't). So instead of filing adjustment now and again in 2 yrs, why not wait 2 yrs?

Am I missing something?

If you get married, you should file AOS asap.

That would cover you for any problems down the road. As long as she doesn't use the EAD, her status under the work visa would be preserved. (from my understanding of this).

I wouldn't wait.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

For example?

She loses her job (for the work visa).

She wants to work at a different job - some work visas are locked in to a paticular company.

for starters.

Also, she can start to work on getting time under the belt to become an USC.

I just read your signature, now I see where you're coming from :)

Thanks that's very good food for thought.
