My fiance arrived here on April 22 on a K1 Visa which will expire about July 22. I plan to get married on July 1 but I am not sure if I can do all the I 485 paperwork before then.

Do I have more time ?

You have till the I-94 expires, not the K-1.

The K-1 is done with anyway, since she arrived.

You should do the AOS prior to the I-94 expires, to maintain her status in the "safe zone".

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You have to get married within 3 month, but you can mail AOS package later, not a big deal. It's better to do it before your visa expire but if you do it after you still good/

April 5th, 2009 -- Biometrics Letter received

April 29th, 2009 -- Biometrics at 9am

April 15th, 2009 -- Transferred to CSC!

May 7th, 2009 -- EAD Approved -Card Production Ordered

May 7th, 2009 -- AP Approval notice sent

May 12th, 2009 -- EAD Approved -Card Production Ordered again!

May 13th, 2009 -- EAD Approval notice sent

*** May 15th, 2009 - EAD, AP received ***

June 24th, 2009 -- AOS Card Production Ordered!!!

best is to do it before the I-94 expires... but if you got married the day before the I-94 expires it would virtually be impossible to submit the I-485 before the last day. Without the I-485 filed your future wife will accrue out of status time (and be subject to deportation) that will ultimately be forgiven when the I-485 is approved. Nobody will come looking, but just be aware particualrly if you live in a border state and venture near the border area and get stopped.

So in the end, ASAP as it is better sooner than later, but better later than never...

GOOD Date April 22nd (LAUGHING) its the date my wife and I got married this year.

The answer is start on the paperwork and get it done NOW and wait until after you are married July 1st and add the Marriage Certificate (COPY) to the packed.

AOS I-485 G-325A (update) (keep old one),

AP I-131 and 131 part -7,

EAD I-765

Go to Civial Surgeon with a filled out copy of I-693 to update need shots

NOT that hard but sometimes our BRAINS make it more difficult then it really is.

Actually, just like payxibka posted, it can be a big deal.

Do a search on this site for posts like this, and there are a few people that have had problems with ICE because they "waited" past the I-94 date to file.

Not saying this to scare people, but do you really want to go through the hassle that could be easily avoided by filing on time?

It is highly recommended that you do. you are 'supposed to' anyway, nothing 'horrible' will happen to you or your fiance if you dont, but your fiance will be 'out of status' during the time period you send the AOS paperwork and you guys get your first NOA1 for your AOS paperwork. For example, if you send the AOS July 21st, it arrives July 23rd, and you dont get your NOA1 until August 1st, during that whole period, between July 21st (any date after July 20th) and August 1, your fiance will be 'out of status'. That means, she wont have proof that she sent in the AOS paperwork, or anything to show the police if she gets stopped. You cant make a copy of an NOA1, to protect your fiance 'if' she gets stopped by the police, if you dont have it yet. That is why it is in you guys 'best' interest to send it ASAP. hope this helps.

April 10, 2009-Biometrics appt. done, in and out in 15 minutes

Nov. 18, 2009-Card production ordered

Her K1 was cancelled when she arrived. It was replaced by the I-94. You must look at the date on the I-94 card. You MUST get married before that date and it is best to file AOS before that date also.

It is recommended to start the process right after you get married. If you wait one or two months is ok, even three months; the sooner the better. Do not wait more than that; it can be dangerous since she will be out of status and she wont be able to work...... congratulations on your wedding!!!

Many people do it after the I-94 expires and get approved, some do it after the I-94 expires and suffer very very badly (like the thread that was quoted) I think the most obvious thing to do if you absolutely cannot file before the I-94 expires (like me and my husband who suffered some bad luck in having to pay $20.000 on our house) Don't travel out of state.

29/06/2004 Met online

24/10/2004- Officially started dating!

-Various Trips Between the USA and Scotland-

25/12/2007- Steven Proposed, and gave me a lovely Ring!

29/02/2008- Sent I-129F to VSC

22/09/2008-1pm - Recieved Visa!

Your I-129f was approved in 108 days from your NOA1 date.
