Hey Vj's members,how is every thing with you guys.

Please i need you guys to help me with sugesstion on what to do now.

I came in the U.S on k1 in june and my staying here will expire on 7th sept 2006.

I am having a little misunderstanding with my Usc fiance and she is threating not to marry me

beuse of some personal isuues.

I want to ask you guys in this forum on what to do if she Refuse to marry me within the 90 days

of entry.What step can I take to legally resove my stay in the U.S.

And what does the law says about this issue.

Hi Valentine,

I remember you, your situation is not uncommon. As a matter of fact i know a couple that had the same kind of issue but they managed to work things out. Be a man and confront these issues, There is a solution to every problem. Marriage is about give and take and many compromises. You realy have to study your fiance and know what ticks at least pending the time that you get your papers. Try and work things out. She has the upper hand for now, so humble yourself and be patient in your dealings. But if things does not eventually work out don't be afraid of any deportation, stay within the law and get your social security card. That's very important. By the way, Is your a fiance a fellow Nigerian? Do you guys know each other well b/4 or just met over these dating websites? Also be prayerful !!! It's unfortunate to tell you that your fiace is the only one that can marry you while you are in the state pending your AOS. So becareful and stay humble. Communication is very important.

Sorry to hear of your misunderstandings. Pray above all things and work things out. The road is rough regardless if you met on-line or knew of each other. Once you come together under one roof, it takes a whole lot of getting to "really" know each other. As an American who married an Nigerian, not only did I have to learn what he expected of me, but we had to compromise on some things. Lifestyles are different, but with GOD and commitment, you can survive.

I pray that you and your fiance, let go and LET GOD, have his way in the relationship. He can work things out for you both.

I agree with Taye500, you must humble yourself and hope that your fiance does the same.

The K1 visa allows you to enter the US for the purpose of marrying a US citizen within 90 of entry into the US. The only way you can apply for adjustment of status (AOS) is by submitting a valid US marriage certificate with you application.

If you do not marry within the 90 days, you must return to your home country or you will be here illegally. There are no provisions for you to be able to remain here.

It's only natural for you and your fiancee to have issues... everyone does. Daivd and I had a few when he was here, and that was only for 4 weeks. All of it was due to misunderstandings... you have to learn how to communicate so that your finace understands your feelings and vice versa. You have to be willing to accept each other as you are and work on being a couple. I hope you're able to work things out.

I agree valentine.. This marriage if it is to work has to be a lifetime work in progress.. trust in God and pray with and for your fiance. Michael and I have had our share of issues.. mainly due to diffrences in our styles of communication.. I prefer to talk tings out while they are fresh he prefer to let things die down. Its important that you understand your fiance's style as well. Ans be humble.. that was the hardest thing for me.. Michael is naturally gentle while I am more direct and agressive. With time your two presonalities will blend together, but it takes patience. We will be praying for you guys and feel free to email us any time. I will have Micheal send you a message ok.

Back to the original question, if your fiancee refuses to marry you within the 90 days, you cannot take any steps to legally stay in the US. You will have no basis to adjust status in the US and would be here illegally.

Sorry if this sounds insensitive.........But, if you came here based upon the premise that you would be marrying her, then why would you want to stay in America now that she has decided to end the relationship??? :whistle::unsure:

Valentine, am sorry to hear that you and your fiance are having experiencing some problems. Its always an adjustment period once 2 people begin living under one roof especially if you both are from different ethnic backgrounds, then there is an period of adjustment that you 2 will experience 2 learn how the other communicates and expresses a wide array of emotions and feelings....I am sure you really love your fiance and want things to work out so the advice that the other VJ's have given is very accurate..Communication, especially learning how your partner is when it comes to disagreements and misunderstandings and recognizing how you come across during misunderstandings based on how your partner interprets what you say or how it makes her feel, lots of patience, self-reflection and humbling oneself to get beyond the anger and beyond the point of wanting to be right is the key to getting to core of the problem(s) you both may be experiencing.

I am not an expert on k1 visa but from what i understand, if you do not marry by the time your visa expires, I do not know what other steps you can take to stay here legally since a k1 visa was specific to the person who petitioned for you. You still have a few months to continue working on things with your fiance, just remind her that you love her and that you are trying your best to understand her and as a couple, it will take sometime for you both to find your rhythm as a couple.. I am praying for you both that all shall be well!

I too hope that things work out with you and your fience. Like everyone has said, communication (open and honest) is the only thing that will make things work. If you or she, or both, decide that you do not want to marry within the time set forth by the government, there is nothing you can do to stay here. The purpose of the k-1 is not to get you here (it ultimately does that, but it is not the purpose). The purpose is to give you and your fience time to be together and get married. If that does not happen, it becomes invalid. The government set it up this way because they feel that if you are not marrying your fience you no longer have a right or need to be here. Now, lots of people disagree as to whether this is a "right" or "wrong" thing for our government to have done (I personally see arguments to both sides). But, at any rate, it is the way the law is. So, if you can not work things out, you will not have a legal way to stay here. I do urge you to work on things with your fience if you feel you two can truely be happy. But, please, please, don't simply try to work things out in hopes of staying. I have seen many marriages (of all cultures) fail and be very painful for all those involved simply because the couple tries to stay together for some reason (immigration, kids, $, family pressure). Ultimately if that is the reason you try to stay together, it will not work. So, decide if she really makes you happy and fulfills you and talk to her and see if you do that for her. If so, than work through your differences with communication and understanding that a strong relationship takes hard, painful, and wonderful work. If not, then understand what the purpose of the k-1 visa was and return home and hope for a relationship that better fits you in the future.

This valentine guy is just too quiet about this whole problem since he post the first message, It's hard to tell who is at fault. But whoever is at fault, i hope this guy is smart enough to know that she has his balls in her hands right now and can decide to Squeeze or smash them at anytime she wants. In other words, i hope his smart enough to be humble and patient with the relationship.
