I just noticed the new 125% poverty guidelines for 2009. I'm currently helping my wife file for AOS, and am wondering... Since I'm submitting my 2008 tax return, will they be comparing my gross income on the return to the 2008 guidelines, or to the 2009 guidelines?

Once a new guideline is published, that's the one you go by. It's the guideline in effect when you submit AOS. Had you filed AOS in January before the new one came out, then 2008 is "supposed" the be the one they go by, even if they don't get around to approving you right away.
