Can someone look at this website and tell me if it falls under IMBRA or not? I really dont want to be guessing on this, as it seems the penalties are pretty harsh.

They admit that they are an IMB, as defined by the IMBRA, and that they collect the required information and perform the required background checks.

OK. i kinda figured yes but wasnt sure. So does this hurt me by submitting that they are in the IMBRA? I mean do they frown on folks meeting from these?

Ok I originally found my Fiance on Heart of Asia, (very thankful to them) but I only paid for 1 month so we could e-mail eachother. Do i need to submit this on my 129f? Why do they care where you found your significant other any ways?

It is a common way of meeting and not a problem. Do not be afraid to mention it.

It could only potentially affect your petition if the "broker" did not comply with the act, but I've never actually heard of this happening, despite anecdotal claims on the HeartOfAsia website.

The statements on the HeartOfAsia website make it sound like everybody who uses any other website that might be construed as an "International Marriage Broker", or IMB, is going to have their petition shot down in flames. They claim they are the ONLY IMB that complies with the law. In reality, by strict interpretation of the act, they aren't even an IMB because they provide the same services for people from other countries, and don't focus primarily on people from the US. Just look at the front page of their site - women from a half dozen Asian countries, and men from a half dozen countries around the world.

The IMBRA makes specific exceptions for "an entity that provides dating services if its principal business is not to provide international dating services between United States citizens or United States residents and foreign nationals and it charges comparable rates and offers comparable services to all individuals it serves regardless of the individual’s gender or country of citizenship."

Most similar sites are not bound by the terms of the IMBRA for precisely this reason.
