Tax issue for SPONSORSHIP

Dear All,

pls read as it is ur story,

me and my wife known to eachother since we were 10yrs. friendship-love-and finally court marriage.(17 yrs of relationship and many more to come)

my wife went to USA on adoption by her UNCLE in july 2003 and working with them at their family store so never thought abt tax. she back to india in Jan 2006 and we did Court marriage in Jan 2006 no one knows until she again return to India in Feb 2008. A lot disturbance in life as family havent accpeted our marriage (HER ORIGINAL PARENTS ARE MORE THAN HAPPY WITH ME ISSUE IS ONLY HER UNCLE). she back to USA in April 2008 and filed for naturalisation and by god grace her hardwork she made it in Jan 2009 and became the citizen of USA. she havent got any regular job till today so she havent file for tax as of today.

pls guide what we do we have filed for spouse visa we got NOA1 as well. What we should do as our marriage and all things were unplanned. How can she sponsor or joint sponsor???

there is nothing intentionally about not paying tax but situation arise in our life due to unplanned matters we are facing some tensions regarding sposnor.

When you get a chance update your timeline it helps others with similar cases.

You have two issues, they are related but not the same.

First, your wife's taxes. On the surface it seems it's not a problem, she filed for naturalization and her personal income tax issue did not come up during the process.

She probably didn't have taxable income, from w2's (issued by an employber) or 1099's (issued by a vendor when you are self-employed), interest income, pension or retirement, etc. So I don't believe that's an issue.

Second, you need verified income that proves that you and your dependents, if any, will not become a public burden. If your wife doesn't have sufficient income, that's where the sponsor becomes important. If she's currently working and earning above the poverty level guidelines maybe someone else in this forum can provide information on how important the previous 3 years of earnings history is.

As far as your relationship and how much you know and love each other, it's relevant to establish that you have a real relationship, it's irrelevant in establishing that you and your wife can put food on top of the table and stay off the welfare roles.

You have two issues, they are related but not the same.

As per your positive reply i assume that a stroong financial sponsor will help us. one more thing We did register Marriage in court as we both are agewise legally OK for marriage but not As per indian hindu tradition like celebration, gathring and all. We are thinking and well excited as we are going to do in this coming September In INDIA. Would it be ok coz we do have some pictures of our honeymoon, and normal trip but dnt have sufficient marriage pics like big gahterings, Vidhi(rituals) and all... we did our marriage secretly but legally. Do we have to produce any Affidavit for 3rd person or lawyer regarding our relationship etc,

if possible pls throw a light on it...Thanks a lot,

I'm not that familiar with the IR-1 / CR-1 process, your culture or the process at your embassy.

I'm new here and going through the K-1 process myself.

My area of expertise is taxation and how it relates to the immigration process.
