hmm, really a close call.

you probably wanna visit a local SSC office/ or USCIS office, wherever you can get info on the green card and find out what to do, as once the green card expires you will be staying illegally..

now i really cant go 2 sleep been trying to send it in from last month lawery said i had time..omg i cant sleep i am worried

my 2 year card expires on june 22,09 i will send in package 2marrow can i still go 2 work when my green card expire

To answer your question. NOA stands for notice of action. After you file I-751. After some time (can be from 1 week to over a month) USCIS will send you NOA. They might send you NOA before they cash your check or after (which happens most of the time but they have sent NOA before cashing checks, make you have sufficient funds for the check) and after some time they will send you biometric appointment letter to have your finger prints plus photo taken a location near by called Application Support Center.

NOA is a receipt of acceptance for your 751 application and it also serves as a temp GC for 1 yr, meaning it extends your work and stay for 1 Yr. e.g. GC expires 04-01-09 will be extended to 04-01-10. So it's just temp GC until your case is approved and you get 10 Yr GC.

Now to your situation. Once can apply any time within and not before the 90 days window prior to expiration to GC but not after.

You should have applied at least 50-60 days before expiration of your GC to give yourself time to get NOA and buy yourself time, just in case they send back your application for some reason and you have to send it back to them again.

I would advice you to send the package via USPS express mail and send a money order for application plus biometric which I and another member did and got NOA within a week. It's not a rule but I think money order is faster. Choice is your, you can still use a check. Double check your document as you are almost near the edge.

Read this thread for complete list of document for I-751 and also to make sure you got all the necessary evidence and paper in order.

I think until you don't get NOA you should work as USCIS hasn't given you the permission too. Because your 2 Yr. GC (work and stay) is expired and you don't a new one from them i.e NOA.

My suggestion would be wait until the NOA arrives and then continue to work.

The best course of action would be to apply ASAP before GC expires and make an infopass ASAP to double check with the immigration officer what to do next.

Will tell you the USCIS field office based on your location.

On the 1st page choose "You need Service on a case that has already been filed " and then on the next page choose "If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment."

Ask the immigration officer there, that you applied and should to continue to work or not.

Thank you i have the money order for 545.00 and i will over night it 1st thing in the morning...i just hope i don't lose my job and please pray for me that i get the extention letter with in a week ...i am soooo stressed out

A lot of employers (if not most) don't keep track of when green cards expire.

They usually check those things when hiring new employees.
