Timeline

Just got an email from CRIS regarding my 485 stating that they require Initial Evidence and that my file is on hold. My questions is: does that mean that 765 vand 131 are on hold as well???

Your help is appreciated!!

I would think it would mean that. Aren't you the person who is trying to circumvent the usual immigration/AOS route after marrying and entering the US on a NEXUS card?

We received an RFE letter and it did place the EAD and AP on hold. I could be wrong, but I don't think they will do anything with your case until you return the RFE letter. It was 3 weeks after our case started processing again that the EAD and AP went through.

Mailed AOS 04/06/2009

Package received 04/07/2009

NOAs received for I-130, I-131, I-485, I-765 dated April 13, 2009

Biometric 1-485 & I-765 scheduled April 29, 2009 letter dated April 15, 2009 (8 days from filing!)

Biometric done 04/29/2009

EAD and AP touched 05/08/2009

I-485 waiting for letter requesting initial evidence 05/08/2009

RFE received for 864 requesting 2008 tax return 05/15/2009

Mailed RFE letter 05/16/2009

RFE response received and case resumed processing (or more waiting) 05/21/09

EAD & AP card production ordered 06/12/09

Received AP 06/17/09

Received EAD 6/22/09

so...here's the scoop:

We get the letter from USCIS...

They need proof of my wife's income!!! My wife's income is over 100K and yet the letter says that her income is below the poverty line....wow!!!

Is this some kind of default thing since her income in Canada last year was pretty small only doing part time consulting work and her declared US income tax was pretty tiny?

I'm really confused how the US system works.....But our combined income in Canada last year was quite high...Are we able to submit this as evidence???

At any rate, they are asking my wife for 6 months of pay stubs , but we only moved here in February!!!

I am sensing a long and difficult process!!!!

Can you get a letter from your wife's current employer stating how much she makes now? I would send that along with the pay stubs. Don't lose hope, once you send this back it may be just fine.

We got an RFE letter for our 2008 tax return, they said they didn't receive mine, but we filed jointly last year so they had both of ours.

I received the same letter asking for tax info and employment letter from NBC. I think maybe they just need another copy there. my EAD and AP were on hold while the case was pending and now they are all resumed. So I guess everything was on hold when 485 is

8/16/2003 Arrived US as F-1

8/18/2003 Met JD and fell in love....

2/17/2009: Finally Married :) JD flew from China for me and got married in Rochester, NY!

2/19/2009: JD became an US citizen!!

4/17/2009: AOS package sent through USPS Priority Mail

4/19/2009: Package received.

6/5/2009: Fingerprint done

6/8/2009: RFE received asking for tax info and employment letter from sponsor

6/11/09: RFE response send out via USPS

6/17/09: case resumed.

6/... EAD AND AP PLEASE...
