I'm applying for advance parole with my I-485 so i can go to my home country in December. I'm sending all my paperwork friday or next monday. Can they deny the advance parole? what is the decision based on?

here is my letter

Description of Travel:

Dear Sir/Madam,

I respectfully request a multiple entry Advance Parole to allow me to re-enter the U.S. after temporary foreign travel.

I would like to visit my home country to visit my parents for pleasure or in case of a family emergency.

Please feel free to contact me if I may be of further assistance.

Sincerely,

Should i add anything...thank you very much

May.29.2009 Got married!!!

July.22.2009 Sent our AOS paperwork I-130(g-325) and I-485(I-131, I-765, I-864, g-325)

July.28.2009 Immigration Received Paperwork

July.31.2009 Received NOA (I-130, I-765, I-485, I-131) and ASC Appointment Notice

August.27.2009 ASC Appointment (biometrics)

September.01.2009 Card production ordered

September.02.2009 Received Approval notice I-765

September.04.2009 Received Advance parole in the mail (I-131) =) yaaay i get to go home in December!

September. 11.2009 Received employment card :)

September.14.2009 Received Request to appear for initial interview

October.21.2009 INTERVIEW

Got approved that same day and i received my Residency Card 2 weeks later

Yes - they can deny it, but usually they do not, if your in the process of AOS.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Given that the guidelines say that the AP is approved based on 'emergency' or 'bona fida reasons', I would take out the part that says you want to visit the parents for pleasure. Don't think that's necessary :unsure:

2009-01-28===> NOA's received in the mail
2009-02-01===> Biometric appt received in the mail
2009-02-06===> Completed biometric appt thru walk-in
2009-02-06===> Applied for expedited AP thru the phone
2009-02-14===> Received AP in the mail
2009-02-11===> Case transferred to CSC
2009-02-23===> EAD received
2009-05-02===> Green card received in the mail, no interview done.

Rarely have I heard or seen anybody being refused an AP. My personal thought: They would gladly give it to you, if you have a genuine reason or not. Either ways, it works well for them if the applicant is leaving the country. Easier for them to deny re-admission:) Btw, you are submitting an I-131, so why give explantions by attaching a covering letter for it. I would suggest otherwise. A cover letter for the entire AOS package is enough explaining the contents. Un-necessary explanations at times lead to trouble. Atleast thats what I think
