algeria K1 visa... this is a problem

Let me try this again...

Hello everyone... I am new and wanted to get some ideas about my situation. I am going to Algeria next week to see my fiancee. We will be doing the K1 visa. I plan on sending the paperwork in november so she should have the interview in march or april. then, I hope to arrive in June and we can leave together. Well.. that is the plan for now.

Here is the problem... her family is very traditional and will not let her leave without being married first. So, we are planning to marry next year in June. After we marry in june... we will leave algeria with her fiancee visa hopefully. I really don't know any other way to do it. If you have any ideas.. PLEASE feel free to share. Thanks in advance.

Get married in Algeria and file for a spouse visa.

May 11 '09 - Case Approved 10 yr card in the mail

June - 10 yr card recieved

Feb. 19, 2010 - N-400 Application sent to Phoenix Lockbox

April 3, 2010 - Biometrics

May 17,2010 - Citizenship Test - Minneapolis, MN

July 16, 2010- Retest (writing portion)

October 13, 2010 - Oath Ceremony

Journey Complete!

Marry her, then apply for the K-3 or CR1. Get married and send the paperwork in as soon as you come home.

Agreed.

It is fraudulent to enter the US on a K1 visa if you are already married. Sorry, but your plan won't work. You will have to marry in Algeria and apply for a spousal visa.

thanks for everyones feedback... this is a disaster...the only option that I have is to marry her there and return.. and hope the parents will accept me doing this...or else she will have to leave her family dishonorably.

I would think that they would rather have her married but physically seperated from her husband than leave unmarried to go live with him.

Agreed with the others that you should marry then file.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

its not a disaster, it would have been a disaster if you went ahead with your plans before asking and doing research. As it is, you have the opportunity to AVOID a disaster and get it all done correctly. Can you hurry and get married when you are there next week? then you could come back and file the spousal visa paperwork and everything should be fine....

Get married in Algeria!!!! Its the best way.

She will be married, her parents should not find this dishonorable. Dishonorable would of been the other way, it will work out.

I highly doubt that they would prefer she take a chance of a denial and permanent ban.

Yep, marry in Algeria, whenever you can and then file for a spousal visa. It's the only way.

Also take the paperwork with you next week. Saves time and money with postage, its super slow snail mail there and back!!!! Look into what you need to marry in Algeria, the U.S. Embassy webiste may help you, or just google it. You will need your paperwork translated into French or English for marriage though. I would love to marry her next week... but what can I do if the mother refuses... in algeria parental permission is everything.. and she has said repeatedly.. not until next summer... I hope she will listen when I explain the situation.. thanks for all of the feedback.. I appreciate the support

Well, then you delay another year until you can go back and momma says yes. You are screwed in this sense. There is no playing USCIS/DOS. If you commit fraud they will find out. :thumbs:

Sorry to hear that u r in that situation i was in it for a few times at the end i found it is not worth it in the past i went through the same thing if u desire to keep her expect to live yr life for her whole family what ever her parents want is her 1st priority even is she here in u.s what ever her parent wants and needs u better prepare to be able to support all else u will have a problem with her u guys will fight over and over mainly it is all cultural conflicts matter of time u will get tired i spend over 3 yrs already no matter what that won't change there mentality that is just my past experience i hope u won't have to deal with one I would suggest u to get marry there but not get involve with any legal document if u do a k1 visa atleast u get a chance to feel how she can adopt the u.s culture and to deal with her family if it doesn't work out it will be simple if u r legally marry there u end up have to go back there to do any divorce paper it is a night mare take some time to think about it love is one thing but being stuck in the middle in between 2 generations that is not as easy to deal with as people think good luck
