Timeline

I am new to this and need a little assistance please. This site recommended to me by my ex husband who used it and swears by it.

After 7 months online, I went to Ghana to meet my fiance and we married while I was there. Now I am back in the US and need to start the K3 process. I read over the I-130 forms and they want affidavits or proof that we are married such as joint checking or joint tenancy but we don't have any of that, for we were only married for 1 day before I had to leave to come back home. I have a copy of my marriage certificate - will this be enough? Also I am having difficulty having my name changed because SSN & DMV do not recognize a forgein marriage certificate.

You can show more proof like emails/phone logs/letters, affidavits from people that know of your marriage.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

They understand that most newlyweds haven't had a chance to live together and so won't have that. It's important to have lots of other proof aside from the certificate though- photos, phone bills, emails, chats etc. The more the better, especially when the petition is for a male from Ghana.

Did you take the certificate into the Social Security office? I didn't have any problem getting that changed- it was the first thing I did a week after the wedding, even before I changed my passport. The DMV did require me to change my social and passport first for a new license. SSA you should have no trouble with though so maybe try going to a different office. Even though the policies are supposed to be the same across the country, sometimes it just comes down to getting the right person at the window.

It's critical that you read carefully and interpret literally. Anything listed after the words "in addition to the required....." is simply NOT REQUIRED.

Also, forget the K3 visa. It's obsolete. Just file the I-130 and follow the CR1/IR1 guide.

I agree with Pushbrk, don't waste your time with the K-3 visa. Complete the I-130 petition for the CR-1 Visa. My husband is from Ghana and I filed both petitions (I-130 and the I-129F) and if you review my timeline, they were approved at the same time. The CR-1 visa is less hassle, more benefits to our spouses upon arrival, and it cost less. You can compare both visas by clicking on the "Guides" heading above.

Also, as Imaisha stated above, take your marriage certificate to the Social Security office first to change your name. Then the DMV will accept a name change based on your new social security card. You are right, the DMV does not recognize foreign marriage certificates (which makes no sense to me).

You will eventually need a certified copy of your marriage certificate or the original once you get to the NVC stage in this process, so if you don't have one, have your husband send it to you as soon as possible.

Soon after our marriage I tried to have my name changed as well. I was told the same information. I contacted an attorney to find out what my options were to bring my husband over and I mentioned the name change. She stated that I didn't need to change my name at this time and that it wouldn't be an issue. I still haven't changed my name and am processing my documents under maiden name. We are planning to marry here in AZ once my husband arrives and at that time I will change my name.

Thank you for your post - I have received some great help from a lady on this site who has been a great encouragment & God-send for me. I just mailed off my I-130 today and I have already changed my name - this is think is a great thing for I am taking on my husband's name. This also helps me feel a little closer to him as I adjust to the new name! I wonder about marrying a 2nd time? Can you do that here in the states?
