Question about Social Security Number application

Hi everyone.

It's been 2 weeks since I entered the US on my K1 visa. I got married this last weekend. kicking.gif and I want to apply for the Social Security Number.

I looked at the application and I have one doubt about it. Where it says "citizenship". I'm guessing I would be "legal alien allowed to work".

Please let me know if this is correct.

I'm taking my passport with my K1, my I-94 attached to it and my Birth Certificate (original in Spanish and a translated copy). Is this enough or do I need something else?

i wasn't sure about which box to tick either so she did it for me. from memory i think she ticked legal alien allowed to work. because k1 is work authorized so you can get your ssn. but when you get it it will have with dhs work authorization only stamped on the card.

If you are going into the office in person you could always do what i did and wait to tick that box and ask which one applies to you unless someone else can confirm that my memory is is not wrong. :unsure:

Wow! That's interesting! It says a K1 can work without an EAD, but a K3 needs an EAD to work. :blink:

We can`t work without an EAD, but we can get a SSN without it, whereas the K3`s have to wait for their EAD to get their SSN as far as I know. I havent applied for one, so I`m not sure what you fill in, I just know that you can get one without having your EAD yet. Gary or someone may have a better idea, I`m sure they will be along at some point to post.

Is this what your talking about? If so Look at: Work eligibility? SSN may look at diff. then USCIS?

The K-1 symbol indicates you are the fiancé of a U.S. citizen. As such, you are eligible for a Social Security number and for employment. To apply for a Social Security number:

• Complete an Application For A Social Security Card (Form SS-5); and

• Show us documents proving:

o Immigration status;

o Work eligibility;

o Age; and

o Identity.

If you are not a U.S. citizen, Social Security must see your current U.S. immigration documents. Acceptable documents from the Department of Homeland Security include your:

Form I-551 (includes machine-readable immigrant visa with your unexpired foreign passport);

I-94 with your unexpired foreign passport; or

Work permit card (I-766 or I-688B).

Yes, legal alien. Doesn't matter if you check allowed/not allowed. Makes no difference. Out dated form. The SS card will have a "not vaild for work without DHS authorization" stamp either way.

Apply for the card in your MAIDEN name. DO NOT try to use your married name (if you will change it) at this time. Wait until you have your green card and go back and change the name.

wrong... K-1 is eligible to apply for SSN. needs to be done before day 76 of entry as the SSA will not accept an application if less than two weeks left before the I-94 expires

I used my married name to get my SSN and had no problems. I brought my marriage certificate, passport and birth certificate to the SSA office. The option I checked was "legal alien allowed to work" but the clerk didn't really use that form. She asked me for the information instead. As long as the staff at the SSA office near you are knowledgeable, you shouldn't have a problem.

Hello, once you are married, you are no longer eligible for a social security card or work, you must file for adjustment of status, you can also file for advance parole (for travel) and EAD (employment authorization document). You could have gotten the soc. sec. card before you got married, but technically you would not be able to work after you marry. Many people have found it quite hard to find employment with a temp. Soc Sec card and no EAD, you will receive the necessary documents usually within 3 mos, so file for AOS, ASAP, Mike & Yizhen
