Question 25 - asks for me to click on the box if i have filed for three yrs of federal taxes. I have done it for the last 2 years, but the 3rd year i havent as i was in univ, and i didnt work or make any money. So what should i do now? what should i click and how should i proceed.

Check the box, provide the transcripts for the 2 years you have and provide a written explanation why you didn't file taxes for that 3rd year.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

do i just send the tax transcript for 2008 or also send the tax return etc for 2008? I have the tax transcripts for 2008 and 2007, so i just wanted to confirm if only the tax transcript was enough?

Instructions state just the most recent transcript is required. More if you think they will help your case.

If you have the transcript, you do not need the 1040/w-2/1099 to go with them, transcript has that info.

I am confuser on how to answer #21 for I-864:

21a. = 1 (since it is just my wife)

21b. = 1 (myself)

21c. = 1 (since I have spouse, whom is the person on 21a.), but heading requests Persons "NOT" sponsored in this Affidavit. Do I put wife as 1 or 0!?

The New Delhi Embassy says to list any family member I am living with , even if they file separately. I have an older brother (who files separately). Do I put him under 21d?

I know I can not double count, but if you add all the numbers, including brother, it comes to 4??? I only have 3!
